Yes, actually. During the 2020 election we were reminded on multiple occasions to refrain from bad mouthing the Commander-in-Chief as that was against DOD policy. Look, dude, I'm as conservative as they come. And while it's fun to go after Captain Noles without knowing who he is, I served under him for over a year before he became Chief of Staff. The guy has been in the Navy for almost 40 years. He entered as a lowly E-1 and made it to E-7 before using the LDO program to become an officer. He's the oldest and saltiest sailor in the entire U.S. Navy. He's also Alabama born and bred. I don't know his politics, but I know he's a good dude and I know he is fair.

Here's the problem and critical flaw with this.
In order to prosecute a military retiree, they have to prove that the statements were either made in uniform or in an official capacity where the remarks could be construed as an official statement on behalf of that person's service branch.
Example 1: A retired officer makes a video and a statement saying "this shite would have never happened back when I was still in." There would be no standing to prosecute.
Example 2: A retired officer makes the same video saying, "As a retired Army Colonel, I can state that this was done wrong." MINIMAL standing to prosecute.
Example 3: A retired officer makes the same video ON BEHALF OF HIS FRIENDS STILL IN...then you have a potential case.
