Obama Judge Permanently Blocks Trump's Proof of Citizenship
A federal judge on Wednesday permanently banned Trump from implementing his executive order that required proof of citizenship when they register to vote.

Boston-based US District Judge Denise Casper, an Obama appointee, said the Constitution “does not grant the President any specific powers over elections.”

Appeal to the U.S. 1st Circuit, however it is left leaning.

I'm sure she says a lot of things.

When is Trump going to grow a fricking pair and ignore these unconstitutional orders from Marxist and usually foreign born judges.

She upheld her own injunction. So noble of her.

Appeal it and gp ahead and tell her to go frick herself.

I think the irs should audit her as well. And her entire family

Which is why the SAVE Act is needed. DJT knows that. Even if EO was good the next Dem would undo it.

If elections are run by the states it seems pretty clear that the federal government which would include the executive branch wouldn't have any jurisdiction under the current framework.

Trump might as well issue an executive order saying the property taxes in Harris County need to go up.

Two different occasions, the state of Arizona passed proof of citizenship upon registration laws. Both times the federal government contested to the supreme court, and in both cases the court struck down the laws because they violated federal law - the Voting Rights Act.

wasn't this decided by SCOTUS last year in that judges can not issue nationwide injunctions.

You know, I think I'm going to start wearing a judge's cloak so I can get away with anything too.

What am I missing that this needs to be addressed?
quote:

The primary US federal law prohibiting non-citizens (referred to as "aliens" in the statute) from voting in federal elections is 18 U.S.C. § 611 ("Voting by aliens").

uscode.house.gov

Key Provisions of 18 U.S.C. § 611It is unlawful for any non-citizen to vote in any election held solely or in part to elect:President, Vice President, or Presidential electors.
Members of the Senate or House of Representatives.
Delegate from the District of Columbia or Resident Commissioner.

ballotpedia.org

There is a narrow exception if the election also includes a non-federal purpose and non-citizen voting for that purpose is separately authorized by state/local law and conducted independently (so the non-citizen cannot vote for federal offices).

uscode.house.gov

Penalties: A fine, imprisonment for up to one year, or both.

ballotpedia.org

This prohibition was strengthened by the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA), which added these explicit criminal penalties. Non-citizens have been barred from federal elections by state laws for much longer (since the early 20th century in all states).

migrationpolicy.org

Related Federal Laws and ConsequencesVoter registration: Federal forms (e.g., under the National Voter Registration Act) require swearing under penalty of perjury that you are a US citizen. False claims can lead to charges under laws like 18 U.S.C. § 1015 (false statements) or § 1425, with penalties up to 5 years in prison.

sos.state.tx.us

Immigration consequences: Unlawful voting (even without a criminal conviction) can make a non-citizen inadmissible or deportable under 8 U.S.C. § 1182(a)(10)(D) and § 1227(a)(6). This applies to federal, state, or local elections.

congress.gov

There is a limited exception for certain individuals with US citizen parents who reasonably believed they were citizens.

en.wikipedia.org

Non-citizens who falsely claim citizenship to register or vote face additional risks, including denial of future immigration benefits or deportation.

bipartisanpolicy.org

Scope NotesFederal elections only: This federal law specifically targets races involving federal offices. Federal law does not prohibit non-citizen voting in purely state or local elections, but no state currently allows non-citizens to vote in statewide elections. A few municipalities (in places like California, Maryland, Vermont, and DC) permit it in certain local races.
