The amount of good oppo research and blackmail material on my generation's politicians will be insane.

i don't think it should be a crime regardless, as long as she knew the photo was being taken at the time and it wasn't some peeping tom issue (which i don't think is an allegation). it's a very big stretch for "blackmail".
