Someone jump on me if I'm not reading all of this right, failure of JBE to sign or veto SB118 by end of day yesterday means LA is now the 21st Constitutional Carry state. SB118 was sent to his desk on 6/6.

During Session: The governor must sign or veto legislation within 10 days of transmittal, or it becomes law without his/her signature.
Post Session: Legislation transmitted with less than 10 days remaining in the session must be acted upon by the governor within 20 days of transmittal, or it becomes law without being signed.

Not exactly. If the tenth day after delivery falls outside of session, the gov has 20 days to veto.

LINK

quote:

§18. Gubernatorial Action on Bills; Sign, Failure to Sign, Veto; Veto Session

Section 18.(A) Gubernatorial Action. If the governor does not approve a bill, he may veto it. A bill, except a joint resolution, shall become law if the governor signs it or if he fails to sign or veto it within ten days after delivery to him if the legislature is in session on the tenth day after such delivery, or within twenty days after delivery if the tenth day after delivery occurs after the legislature is adjourned.

Well crud, didn't realize they had adjourned on the 10th.

Edit: just wishful thinking

Also, the official date it was sent to the governor was June 4, 2021. So June 24, 2021 is the deadline

So why hasn't he? (Honest question). It would seem he would have done it already and made a firm statement. The longer it goes the more optimistic I am.

So if correct, two more days and it becomes law? I’d assume since it passed both house and senate with veto proof votes, his veto won’t matter. He probably doesn’t support the bill, but also wants to save the embarrassment of getting overridden, so he’ll just not sign it and let it become law without his signature.

Is that how it works? I'm a little ignorant on this I guess. So we did in fact get very majorities, but he can veto all he wants and it won't matter? Good.

It passed with veto-majority votes.

However, if the Governor vetoes it the Senate can override his veto with another vote. But since they're out of session they have to reconvene to do so. They've never done that.

They could've presented the bill with that measure letting JBE know his veto was irrelevant and it is now a law but they didn't. If JBE vetoes, it's dead.

Not how it works....definitely not how it works out of session.

Senate really made no indications that they would actually override a veto. I'd bet my house that they won't even reconvene in a session to hold a veto vote.

All this was known when all those Ds voted for the bill.....every one down to a man knew it would never become law.

The real news here is that it probably will become law when we get a R governor.

You’re the bookie here. Odds of a veto session to override this?

So then why hasnt he vetoed it yet? What's the point in waiting since it's been on his desk just sitting?

Because then he gets to say he opposed it without actually having to bother with a veto. It’s all optics.

Every state has the constitutional right to carry. It’s just that some states ignore the constitution.

the right of the people to keep and bear Arms, shall not be infringed.

If he does do that it means he is probably running against Kennedy for Senate.
