If I were a Juror, and have to listen to this monotonous rewording of the same questioning, over and over, I would certainly be over this.

It's what the prosecution's expert testified to.

The first thing the judge said was that he usually admits the evidence and they let the jury know it is not the original and how it was enhanced. I guess the confusion was the judge meant you have you bring in an expert to explain to the jury how it was enhanced.

You're right but I thought he clarified pretty quickly and before Binger asked.

You think you can zoom up even a good drone camera image of fast action that is far from the sensor to 3' x 5' without some alteration of the underlying image?

Interdasting.

At the very least, expert testimony to verify what inaccuracies might be introduced by "pinch and zoom" particularly to the orientation of the gun barrel on such an image is very appropriate.

the judge also said he usually gives like a week for tech experts to look into items like this before allowing it to be entered

Upscaling an image inserts new data. Some techniques involve interpolation, some techniques involve AI extrapolation. Extrapolation is effectively making stuff up that may be true but may not be true, if the Apple iPhone uses extrapolative techniques then the evidence is not permissible.

It could be enhanced many times tbh. It could have been enhanced by the drone, the operator, then to other devices. Especially with drone and image software there is artificial change the usually automatically happens.

Yeah, there is software "optimizing" every image and video taken nowadays as it is recorded.

Of course, the images will be enhanced on playback as well unless you are using some old PC and software or can turn all the setting off.

ETA: The judge seems like he is intentionally being a hardass because the prosecution ticked him off.

His question right before the video was pulled up was, "Have you told us EVERYTHING you did up to THIS point?"

So, I suspect the video will show Kyle scratching his left arm pit, or farting in the wind, or sneezing, you know, something really important for that prosecution Gotcha! moment.

Yep. As soon as he asked the question, the lawyers on the Rekieta Law stream said "That's bait". Unfortunately, Kyle took it and then they said they were going to show an iPad video using pinch and zoom.

This was the gotcha moment he's been fishing for for the last hour or two. Thankfully the defense finally woke up and objected.

It’s a very sobering realization, that most of us may have already arrived at but now is inescapable, anyone watching this and still claiming he’s a murderer is too far gone and can’t be saved.

Rekieta Law
while I agree with their comments on the defense in principle, in hindsight, the number of objections required would have made Richards look like the antagonist when its clearly Binger right now.

IMO, the defense just wanted to get a break so the jury wasn't led directly from that statement into the video. That the judge is insisting on an expert to qualify pinch and zoom is just bonus.

But that's exactly what happens. Images, depending on the encodation, purposefully exclude data to keep file sizes manageable. JPEGs are notorious for losing integrity.

When you zoom in on an image the app or software creates additional pixels using it's best estimation of what data should be there according to what pixel is next to the one it fills in. Higher end software, like PhotoShop, even allows you to adjust how you want that interpretation to take place.

So if they are going to zoom in on an image, the software will interpolate the data and add or delete pixels and information. So what you'll see zoomed is factually inaccurate to what is actually there.

It works wonderfully for day to day stuff, but if someones life is on the line because of a detail that software may add or remove, you can not rely on it being accurate.

Damn y'all are a sensitive bunch with the downvotes aren't ya?

7 downvotes as I praised the defense for good strategy to thwart a prosecutors exhibit

My poor man Android's "night sight" can take a picture in near complete darkness and use AI to add in color and images which is amazing but it's not always 100% accurate.
