If he would declare a mistrial when is it done. Let's say we get a hung jury and he makes that announcement. Does he then say however, because of the State's obvious jackassery I am granting a mistrial with prejudice.
Honestly, I could see this happening.
The judge doesn't buy that drone footage at all, and with its background and now the compression, along with the previous misconduct during Mr. Rittenhouse's cross examination.

If they retry, and the dude changes his tune the second time (the one that said he was shot after raising his own gun) does he go to jail for perjury and make himself a bad witness to even use since he said one thing first and another second.

When a Karen is your jury foreman

Posted on 11/18/21 at 2:22 pm to plaric
No, because Binger will protect him from any potential criminal charges.

As I recall, Walker pardoned zero people while in office.
So you wouldn't want Walker.

the whole provocation argument is manufactured bullshite. According to what I have seen on the charge, "Simple provocation occurs when the defendant engages in unlawful conduct likely to provoke a violent response." Unlawful conduct is a crime. Rittenhouse was not charged with a crime related to allegedly pointing his gun at the Zidinskis. There is no evidence from anyone at the scene that Rittenhouse pointed his gun at anyone. The only testimony is by the officer who was not at the scene, did not take the video, who doesn't know where pixels are added when using the software, looking at a blurry picture and claiming he sees Kyle pointing a gun in the blur.
He should not have been allowed to testify as that is the ultimate issue of the uncharged, unlawful act of "brandishing" that allegedly supports the provocation. That should be up to the jury to decide and only if Rittenhouse was charged with the unlawful act, which he wasn't.
Smoke and mirrors

Right, and if the foreman is a hold out she could say I am done. You are not changing my mind, period.
Sure, in which case hung jury, no conviction. They aren't going to get 12 people to agree on any of the homicide charges.

he does, but hes coming off extremely bitter about not being asked to continue on the defense team.

could be but considering he was brought in mainly for jury selection and had all these people on his team identifying traits and personalities means he has some experience with this stuff.

We are just tired of his constant harping on jury selection because they turned him down.

quote:Thats moot at this point.
Apparently that doctored still would not be in evidence if the defense had not put Kyle on the stand.
I have yet to hear one thing that the defense benefitted with that move.
Those stills should have been tossed out multiple times now.
First, when everyone first got to even see the blurry arse pictures that you can’t make shite out of. To this day, the only people who see Kyle pointing a rifle on his left side at Zeminski are those that desperately want to see it like that. And even they are almost assuredly lying to themselves, and without shame because of obscene bias.
Second, when Binger demanded it showed Kyle aiming his rifle from his left side, and then Fatlock claiming there’s no such thing as left/right handed guns. The illogic and lies are just off the charts.
Third, when the “expert” tech guy admitted he didn’t know how the “predictive pixel image enhancement software” even worked, and we learned the software company website even says not to use their doctored images as “evidence”. How in the blue frick could the judge allow digitally enhanced pictures that are not only still blurry as all hell, but the enhancement company “expert guru” can’t even explain what and how it was enhanced???
And lastly, when we learned just yesterday that the prosecution not only copied and modified all of this from a Fox News airing, but then changed the file name, saved it in a drastically compressed size and bitrate low def version, and then this is what they supplied the defense with in discovery. So either by unbelievable negligence, or outright purposeful deception, the evidence is wildly tainted because the defense was not given a chance to counter said doctored pictures with viable like and kind evidence.
This judge is an absolute toolbag and Kyle’s defense team are inept as frick buffoons.
Kyle getting up on the stand shouldn’t matter. It was a calculated risk that didn’t backfire… IF, the judge and defense weren't doing horrible jobs.

I wonder how many votes a candidate would get running only on a single promise:
"If elected I will pardon Kyle"
