Uh no. It’s unconstitutional.

You can’t deputize random attorneys to be a federal judge. Only the POTUS can appoint a federal judge and he sure as shite didn’t appoint this “high profile”
DC Lawyer.

I hope the DC Cir rejects this ridiculously expensive law review article with no legal authority to be submitted and sanctions him. He needs to be kicked off the bench.

I’m wondering if he’s caught wind of potential impeachment rumors - or he’s afraid it’s coming - so he’s lawyering up.

In general, a US Attorney thinks anything done in furtherance of getting a conviction is all above board. Such as instructing witnesses to lie to the court or covering up that you are having an affair with them.


I think Ted Stephens was a piece of shite but his corruption trial was probably the closest thing to a Stalinist show trial we got before the Flynn mess.

I am no lawyer, but it appears to me the Appeals Court is trying to justify a decision by Sullivan. This does not look like a slap at a judge, but more like a chance to say he really has good reasons for denying the dismissal. They can uphold him ultimately, knowing that he’ll have to go the Supreme Court. The Supremes won’t get around to it until after the election. This appears to me to be an attempt to run out the clock before the election, thus depriving Flynn and to a degree President Trump vindication.

Remember in the "Untouchables" when the Judge comes back out, is scared out his mind and tells the bailiff to get the jury from the court next door?

The prosecutor asked Kostner ...."What did you tell him when I left?" "That his name was on the list too." "His name is not on the list." "He doesn't know that."

Who got to Sullivan and what is he involved in that has him so scared? Someone needs to look into his bank accounts.

They scheduled a hearing on the writ instead of denying it immediately because this is shady as hell and they wanted to give him a chance to either explain himself or reverse his actions.

Taking this particular action has to be seen as an affront to the court because they wanted HIM to respond, not his attorney.

What may have been a simple chiding before won’t be at this point.

I don’t think his bank accounts are necessarily the problem.

Between rumors of him colluding with the US attorneys and Flynn’s defense to railroad him and the fact that he has coveted several other high profile political cases in the past few years, a deep dive into his communications with various groups should prove interesting.

A judge has a right to protect the administration of justice in his court from DOJ shenanigans.

I’m sure a deep dive into it will show that Sullivan was aware of everything going on then pulled a Claude Rains and was “Shocked, SHOCKED!” at all the corruption going on after it was exposed elsewhere.
