Gays can get married in every state in the U.S. Name one state that has a law that says a homosexual is prohibited from getting married. I've known several gays who got married in Louisiana.

Is it a right to drive a car since some people have that "privilege" and some people don't? What about home ownership?

My point is I get annoyed when people use the word "rights" so freely when they are incorrect in doing so.

I'm always conflicted over these rulings.

On the one hand, I believe that if the government insists on regulating marriage contracts than they have an obligation to allow all consenting adults to enter into such contracts with whomever they so choose.

On the other hand, I am not a fan of judges unilaterally discarding the will of the people. Now in this instance, the will of the people is largely driven by ignorance and superstition, but who is to say that it will stop there?

You proved my point. There is no law that says marriage is a right. Only in court decisions has marriage been referred to as a right. Thank you.

In your first example Maynard v Hill, the Supreme Court essentially ruled that the Legislature of Oregon had a right to grant a divorce (Back in the good ole days when you had to get the state legislature to grant you your divorce, and before these evil no fault divorce laws). The Federal Government had no role to play in such matters.
