Most "ronbots" are in total agreement that what Dems and the 3-digit agencies are doing is absolute bullshite. The narrative that Desantis supporters are never-trumpers is mostly made up.

At some point, a judge will have to challenge this. I just don’t know how you get to an unbiased judge.

None. I’m not aware of any fact set that would support this being done in the past.

That doesn’t mean Sec 793 is novel or doesn’t have well developed case law for retention prosecutions.

I really don’t know if Trump will be charged with this but I guess we’ll find out before too long.

783 become law in the '40s. So yes, it is not novel from that perspective.

However it is novel from the perspective that declassified documents by the president are subsequently designated as "national security" documents by the DOJNSD then the president who declassified the documents is charged with a national security 783 violation. The 11 Circuit gave deference to the DOJNSD in the MAL documents case to make that classification on 09/21/2022. LINK

We do not live in a remotely free country or anything resembling a just society. And, yes, for many people in history that was the case for many years. But instead of correcting those injustices and deprivations of liberty, we’ve just written them large.

That's not going to happen. They get to pick whatever charges they want, make up whatever meaning they want for the claimed violation, change it as necessary to not drop the charges each time they are proven wrong, and pick whoever/wherever they want to proceed with the above. It's like playing a game where you get to change the rules as you go and decide/change at any point, what the winning outcome is, and you get to continuously do it so it works perfectly against your opponent.

I don’t see factual support for this yet. I’m aware of the efforts to declassify the Crossfire Hurricane binder but I’m not sure that’s all we’re dealing with here.

Courts historically give some deference to agency classification determinations but whether the information at issue is National Defense Information is an issue of fact for trial.

That's why they call it lawfare.

We are witnessing the federal government with almost unlimited resources conduct lawfare against a private citizen. Almost anyone else besides Trump would be crushed by the process in the first week.
