We need to get the wheels in motion on an Amendment to limit the SC Justices to 9 maximum.

Here is a LINK to the process

Basically:

2/3 of Both Houses of congress

or

2/3 of State Legislatures (Convention of States)

Then it must be ratified by 3/4 of the states.

This is a tall task given the division of the political parties, but surely even the Democrats can see the future issues of NOT doing this. Especially if DJT has a nice majority of the Senate to confirm appointments.

If Trump wins, let's make that amendment say capped at 11, you know, for anticipated population growth or something.

With the current entrenched state of our politics at the state level, we may never amend the Constitution again.

If anything they should abolish the 17th amendment and probably the 19th as well

2016 broke the Dems. If Trump wins again either their party will collapse or they will go irretrievably insane. I do not see a constitutional amendment passing anytime soon with the level of polarization we are seeing.

Honestly don't want this for a Constitutional Amendment. For one, it ties our hands regarding doing the same thing if needed; remember Republicans were behind the 22nd Amendment on presidential term limits to counter FDR. Without it Reagan probably could have gotten a 3rd term but his health was declining at that stage. Trump could keep going though.

Also, dems may threaten to pack the court (you gotta win first guys!) but we all know what their intent would be in doing so and we already have an amendment to counter their actions: The Second Amendment.

We aren’t going to see an Amendment passed on anything for a long, long time. There is far too much divisiveness in the political arena right now to ever get the votes needed for a new amendment. And hell, the last substantive. Amendment passed was in 1971 lowering the voting age to 18. The most recent amendment in 1992 regarding congressional salaries is pretty unimportant IMO as it has little to no effect on the population and our rights

Nah.

quote:

There is no prohibition in the United States Constitution that forbids any state from exiting the union. The Constitution of the United States actually defines the specific acts States are forbidden from committing in Article 1, Section 10. Nowhere in the remainder of the Constitution is the issue of a State leaving the Union explicitly forbidden, nor is power ceded to the federal government to prohibit one from doing so. In this silence, the Tenth Amendment to the Constitution rings loudly.

quote:

“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

— Constitution of the United States, Tenth Amendment

This deafening constitutional silence, coupled with the definitive reservation of power by the States, leaves the decision to the people of a State and to those people alone. For this, we have to look to the Texas Constitution. Article 1, Section 1 not only expressly reserves all sovereignty not granted through the United States Constitution, but it also sets the conditions upon which Texas will remain in the union.

quote:

Texas is a free and independent State, subject only to the Constitution of the United States, and the maintenance of our free institutions and the perpetuity of the Union depend upon the preservation of the right of local self-government, unimpaired to all the States.

— Texas Constitution, Article 1 Section 1

In the very next section of our governing document, the power to determine how Texans govern themselves is clearly declared to reside in the people of Texas alone.

quote:

All political power is inherent in the people, and all free governments are founded on their authority and instituted for their benefit. The faith of the people of Texas stands pledged to the preservation of a republican form of government, and, subject to this limitation only, they have at all times the inalienable right to alter, reform or abolish their government in such manner as they may think expedient.

— Texas Constitution, Article 1 Section 2

When they don't, we can use it against them in 2022.

I’ll say it again… what in the hell does the number of inhabitants in the United States have to do with the judicial process? You’re confusing it with electoral votes…

I think Republicans take it all this election cycle. House, Senate, and retain Presidency. As far as the amendment process goes, let's wait and see what the final map looks like. Projections I've seen show an awful lot of red. I think Trump is going to be able to accomplish a lot in his second term and I wouldn't be surprised to see some amendment actions made.

We need term limits for Congress first and foremost, imo.

You joke, but there is a sound, originalist argument to expand the Court to the number of federal circuits. There are currently 11 federal circuits.

Let's go ahead and make it 15 for now, then Amendment it in.
