Fort Worth man who shot a Texas state trooper will NOT face charges

“Brake check” refers to someone slamming on the brakes, forcing the car behind them also brake suddenly.
King said he thought it was road rage – especially when the driver started chasing him, even onto a Walmart parking lot.
"That's where I saw him giving me the finger,” he said.
Concerned for the safety of him and his wife, King said he tried to speed away through traffic but the driver kept coming.
"He was going into oncoming traffic and made a bus swerve,” King said.
King said he did notice some flashing lights in the grill of the pickup but didn't think anything of it at the time.
"They didn't seem to be very official. I had never seen a police vehicle that was a gray Chevrolet truck,” he said.
The Kings said they thought they finally lost him, got home, backed into their garage, and immediately called 911.
A few minutes later, the same man in the same pickup pulled up in front of their house.
King said he watched on his live camera system as the man pulled what he thought was a gun out of the back -- and then approached the house and knocked loudly.
"I've never been so scared in my life. I really felt as if he were there to harm my wife and I,” King said. "I yelled, ‘Please go away. We called 911.’"
The camera captured what happened next.
King shot through the door. The man was hit in the shoulder and ran.
Fort Worth police and a uniformed state trooper quickly arrived and took King and his wife into custody.

GOOD.
Cops get away with too much shite anyway. They do whatever they can to get around the constitution if they THINK they got their man.

I’m surprised he didn’t get stuck with that if nothing else.
If he kicked down the door and you feel you were threatened… defend yourself. No warning shots… no announcements other for them to leave and you have called authorities.

We had a LEO here in SC shoot a homeowner through the door a couple of years ago. The homeowner's alarm system going off is what got the LEO to the house in the first place. The LEO saw the homeowner pointing a gun through the window of the front door and blasted the guy thinking he was a burglar. Fortunately, the homeowner survived. The LEO wasn't charged with anything.

Technically in Louisiana you could shoot through the door of a home or car IF they person was trying to get in UNLAWFULLY.
I would never recommend it, but I pressured enough people who can offer legal advice enough to be told "this is not legal advice but technically it would be legal". I don't know anyone who would think this is a good idea short of shooting someone ACTIVELY shooting at you on the other side.

If someone follows me to my house and comes to my door with a gun in their hand they are going to get shot through the door or window. I am not waiting on them to come in my house. I'd rather be judged by 12 than carried by 6.

Glad the guy didn't face charges but firing through the door is really not a good idea, unless he's also got video of the trooper trying to break through the door.
From the article, trooper *sounds like* he was on a power trip but couldn't tell why he was mad at this guy if he was in front of him?

Technically you can. If I’m not mistaken… MIssissippi too.
BUT. You are more than likely going to have the burden of proof placed upon you. If they break in, and you defend yourself, you can keep you trap shut and have your lawyer speak through the phone and you will more than likely be left alone to fix your door.
Also, if you shoot through the door and miss… and hit someone else.. that is on you 100%. And it said it hit the guy in the shoulder, a few inches to the side and it’s going into the house across the street.

I can't speak to why the trooper was mad, but when I brake check someone, it is because they are tailgating.

But he should face something for shooting through a door when an innocent kid or bystander could have easily been shot here. He put the lives of folks around that neighborhood in danger with that move.

Depends. Was the "trooper" trying to gain entry, therefore, putting the shooter and his family in danger? If so then I think TX law doesn't require the door to open. Also, the shooter had a view via his video.

If he put his hand on the door knob he was trying to gain entry. Any attempt at entry is justifiable. Not just forcible entry.
