Fellow Louisiana Bar Members, did you know LSBA has taken positions on 2020 Bills?

You didn't?

Not surprising since you can't find the information anywhere on the LSBA website (or on the Board of Governor's Page).

However, a buddy forwarded me the Legiscon Status Report for them. Here are some of their positions:

HB9 - Omnibus Premium Reduction Act - OPPOSED
HB 90 - More transparency to Judiciary Commission - OPPOSED
HB 106 - Equal Pay for Women - SUPPORT
HB 148 - venue for delictual actions - OPPOSED
HB 207 - reduction of jury threshold - OPPOSED
HB 214 - attorney advertising from Supreme Court - OPPOSED
HB 238 - establish Louisiana Employment Non-discrimination Act - SUPPORT
HB 258 - no pay no play - OPPOSED

Apparently, the Dems and the Plaintiff's bar control the Board of Governors. There are plenty of others, going just as you would expect.

Funny...I don't every remember receiving a ballot for any of this, but my dues are being used for this shite?

Not trying to be a smartass here but it would appear you're a lawyer so do something about it? Whether legally or public pressure.

Oh, don't worry. I am about to raise all sorts of Hell.

I just wanted others to be aware so they could follow suit should they wish.

i don't see why the LASC should be the arbiter of this and not elected officials.

HB 90 - More transparency to Judiciary Commission - OPPOSED

same as above

ESPECIALLY since these are elected positions

we give way too much power to our Supreme Court

quote:

HB 258 - no pay no play - OPPOSED

i think Np/Np is pretty draconian and the type of law i hate

if you want to deal with uninsured drivers, address that directly. don't piggyback on something unrelated

Such BS. Mandate membership and unnecessary dues and fees, then use member money to take political positions. Sounds a lot like mandatory union membership which has been stricken down.

FYI from LSBA website:

If you have any questions, please contact the Legislation Committee staff liaison, Richard P. Lemmler, Jr.

email is rlemmler@lsba.org

ETA: there is actually something posted on the LSBA website about current bill positions: PDF from LSBA website on current bill positions

Not a lawyer...Is this the law that says if you are uninsured you cannot collect against an at-fault insured driver?

I understand the merits of wanting this law. But, how is that legal? Do they use the whole driving is a privilege, not a right argument. And carrying insurance is part of the privilege?

yeah. currently it's the first $15k, which excludes the Morris Bart types but allows recovery if it's a legit, serious injury

the proposed law is $0 recovery, which is pretty insane

something like that. i don't know it's constitutional history but i'm sure it has been challenged. it's all bullshite

One of these days, maybe in the not too distant future, the Supreme Court is going to rule that it is unconstitutional to force attorneys to pay to be part of state bar associations.

Boy will that be great.

Pretty sure suit was filed in the Eastern District regarding the forced payment of dues being against the First Amendment. I’ll see if I can find a link.

ETA: LINK

Dismissed earlier this year.
