Federal judge removes Bureau of Land Management Director from office

Of course it's an Obama judge. Says Pendley has illegally held the office of interim because he's never been confirmed by the Senate. What a crock of shite. So is this judge saying an interim director is not an official title?

A federal judge on Friday ordered William Pendley to be removed as leader of the head of the Bureau of Land Management (BLM), a role that typically requires Senate confirmation.
Judge Brian Morris ruled that Pendley "served unlawfully as the Acting BLM Director for 424 days" and enjoined him from exercising the authority of the agency's director.
The ruling was issued in response to a lawsuit from Montana Gov. Steve Bullock (D) challenging Pendley's continued tenure and follows significant scrutiny from conservation groups.
Pendley has led the bureau in a temporary capacity since July 2019. His role at the agency has come under scrutiny because he has not been confirmed by the Senate.
He's also received criticism for advocating for selling off public lands, voicing skepticism about climate change and making comments about Islam, the Black Lives Matter movement and undocumented immigrants.
Pendley remained in his post first through a series of "secretarial orders" put forth by Interior Secretary David Bernhardt and later, as reported by The Hill, through "succession orders," with which Pendley gave himself the authority to remain the temporary leader of the agency.
Morris, an Obama appointee, ruled that both a secretarial order and a succession order "represent unlawful attempts to avoid the constitutional requirements of the Appointments Clause and the statutory requirements of the [Federal Vacancies Reform Act]."
Interior spokesperson Conner Swanson said in an email that the department will be appealing the decision "immediately."
"This is an outrageous decision that is well outside the bounds of the law. It betrays long-standing practice of the Department going back several administrations. Unfortunately, it appears the bias against this Administration was just too great to overcome," he said, pointing to an instance where a succession order was used by the Obama administration.

Have we had a recess in that time?
Trump has the ability to place a temporary appointee into that position until after a recess has been taken and returned from IIRC. And if he has been confirmed in another position at BLM, then he is cleared to run the agency until another official is officially installed.

Easy fix here . Since he has been removed and no longer interim, OMB can just do another interim appointment . He’ll be starting with a clean clock and staffed to his liking !

As someone referenced upthread, Andrew Jackson’s retort to SCOTUS ruling against them was “They have made their decision. Let’s see them enforce it.”
And this ain’t SCOTUS. I don’t even think it is an appeals court but instead a district court out west.

The majority of people opposed to him and the handling of that position don't give a shite about any of that, but this:

Yeah, there isn't a conservation group in this country in favor of that.
Republicans at the national level do themselves no favors with white, western hunters (or even eastern public land users who care about that sort of thing) by supporting the selling off of public lands.

Why hasn't he been confirmed? Republicans hold the Senate. Can't imagine this involved a lot of heavy lifting. Appears as if they didn't do their job. What a surprise. This government we pay for

Some suspect it has to do with protecting some western senators, like Corey Gardner, in an election year. Hell, Gardner wasn't the guy who came up with the Great American Outdoors Act, but his name got attached to it as a way to make him look good and pro-public lands, and to get it off as a "bipartisan" bill.
He, and other western Republican senators, can't save face if they confirm a known anti-public lands guy like Pendley. It would be disastrous for re-election in their states.
