There is a crime fraud exception to confidentiality which this judge has ruled applied here, as I recall. In short, if the communication was used in furtherance of a crime then it is not shielded by confidentiality.

A few questions on procedure:
1) when does the Trump team file the complaint?
2) Is the " evidence" in question known to the attorneys and Trump at the time of filing
3) If not, when are they made aware of the discrepancy?
4) when made aware, does the Trump team file an Amended complaint?
5) If an Amended complaint is not filed, why not?
I'm still trying to see how a case in the 4th Circuit is being influenced by a judge on the 9th Circuit....unless this is connected to actions in Arizona. If not then this judge is overstepping.
However, if Trump and his team were aware of the discrepancies and the lawyers were aware of it. What are their reasoning from withholding the discovery from the court? Most of the time in civil cases the attorney is obliged to file an amended complaint.
