Also, how is he not absolutely immune from this prosecution? Ignoring the strength of the case, this should fall under executive function which would make him immune.
There is a universe where the DOJ files charges against Obama only to have the Courts dismiss them under absolutely immunity thanks to Trump versus the US and then Trump publicly takes credit for Obama not being convicted.

Tulsi and Marco have been 10 out of 10 as members of the Trump administration.

Remember the hypos during the litigation re: Trump about murder?

quote:
"I'm going to give you a chance to say ...if you stay by it: The president decides that his rival is a corrupt person and he orders the military, or orders someone, to assassinate him -- is that within his official acts for which he can get immunity?" she asked.
"It would depend on the hypothetical," Sauer answered. "We could see that could well be an official act."
Sotomayor pressed on that point: "Immunity says even if you did it for personal gain, we won't hold you responsible -- what do you -- how could that be?"
Sauer pointed back to a U.S. Supreme Court ruling from the '80s that held a president is immune from civil liability related to this official acts, which Sauer said is a basis for their own argument now about criminal liability.
"That's an extremely strong doctrine in this court's case law in cases like Fitzgerald," he said.
So even arguing it's sedition, which is a major stretch, it involved the executive function of intelligence/national security.

Democrat 100D Candy Land: prosecute Trump knowing they'll get the USSC ruling hoping that it protects Obama, ultimately.

Dems will piggyback on their attempt to destroy Trump and say Obama was acting in his official duty as president when he conspired with his merry band of frickheads. Should be an entertaining week or so.

Tulsi is setting herself up nice for the future with the voters that are sick of the same ole shite in Washington politics.
If this administration does nothing (which I fully expect) it will cost them big time in 2028. Maybe even next year too.
Trump, Patel, Bongino and Bondi better start nailing scrotums to the wall or they are cooked. You can not campaign on cleaning up the corruption then continue to look the other way when the corruption is shown to you.

oh bullshite - as much has he deserves it, no way in hell will they put a once-POTUS in jail (not named Trump)
I think the best we can hope for wrt Obama is a PARDON from Trump - and I would like to see it make complete revelation of the seditions & crimes he was involved with - remove his security clearance - nullify his retirement - take away his passport - make all his initiatives inactive - restrict his travel - declare him persona-non-grata at any public function and highlight it all in his 'library' for historical record. Give him a permanent 'security detail' that will not only protect him, but report on his activities and contacts. And sort out his birth certificate.
As for the others - Comey, Brennan, Clapper, Schiff et al - with every criminal referral relative to their actions to put them in jail for as long as possible.
And just for fun, bankrupt them with any 'lawfare' actions that can be conjured up.

AI Overview
The Supreme Court ruling on presidential immunity, specifically in the case of Trump v. United States, does not explicitly state whether it applies retroactively to previous presidents. However, the ruling does establish a framework for determining presidential immunity based on official vs. unofficial acts, which could be applied to past presidents.
Here's a breakdown:
Core Official Acts:
The Supreme Court ruled that former presidents have absolute immunity from criminal prosecution for "core" official acts, those within their constitutional authority.
Other Official Acts:
The court also established a presumption of immunity for other official acts, meaning a former president is generally immune unless the prosecution can prove the act was not within the outer perimeter of their duties.
