The population of San Quentin state prison has been ordered to be reduced to less than half its capacity by a California appeals court.

The Associated Press reports that the court cited “deliberate indifference” to the coronavirus pandemic’s effect on the prison population in its decision. Unless prison officials successfully appeal the decision, they will have to transfer or parole about half of the roughly 2,900 inmates currently at San Quentin, the news service noted.

They should drop the prisoners off in front of the judge’s house and in their neighborhood

San Quentin is no joke. That's where the most severe offenders in California go and that's also where they house their Death Row inmates. It's also presently home to the world's largest collection of serial killers.

Interested to see how this shakes out as most of the inmates there are probably in for very serious crimes such as rape and murder.

I guess they'll have to draw straws to see which 50% get the death penalty?

If they would enforce the capital sentences they already have, they could probably reduce it enough to meet the court order.

we need to ask Kamala why does California still have a death row. That's for states like Louisiana.

they think they're better, they need to do better

Oh goodie. Now everybody is even more likely to get robbed, raped, assaulted and the cartels can even further their reach. Thanks, Libs.

Judges consistently make the mistake that legislators will “do the right thing“. Here we have a judge who disagrees with the executive branch on how to operate the prison during the Covid outbreak. The court knows that it’s ruling is unreasonable and that the administration cannot reduce the prison by 50% capacity without legislators intervening from a budgetary standpoint ( fund more prisons or low security facilities like half way houses). I’ll bet you a dollar that the legislators will never agree on how to respond to this ruling and as a result the executive branch will have no choice but to comply and begin to release prisoners so that the court does not hold them in contempt. It’s idiotic. I have seen this happen thousands of times with judges. This is an example of legislating from the bench As the judge has no means to control either the operation or budget of the prison, but issues a ruling that clearly impacts it without regard to its impact upon the rest of the state.

They have to let the prisoners out since everyone else is fleeing the state.

The new ruling came after Ivan Von Staich, a 64-year-old prisoner currently serving 17-years-to-life for second-degree murder, petitioned the court, according to the news service, which added that b oth he and his 65-year-old cell mate tested positive for the coronavirus while sharing a cell “so small that you can touch the walls with your hands.”

OC Weekly

He was released on Nov. 17, 1983, with orders to stay
away from
the couple, who were married by then. Around 1 a.m. on Dec. 8, 1983, the then-27-year-old arrived
at the Toppers' Santa Ana home, cut the outside telephone wires with
pliers and kicked open the front
door. Wearing gloves and armed with two hammers, he walked to the
master bedroom and struck Cynthia with the claw hammer before she ran to
the kitchen.

Robert, armed with a gun, fired at Von Staich, hitting him and
severing one of his fingers. But Von Staich managed to get the gun away
from Robert before repeatedly beating him with the hammer. While
Robert was lying face down on the ground, Von Staich fired the gun five
times at close range, hitting Mr. Topper in
the head, chest and neck, killing him.

Von Staich then ran to the kitchen looking for Cynthia. He pistol whipped her
and shot her in the uterus before running to a neighboring house to seek help for his
wounds. She spent months in a coma before coming out it. Having suffered several skull fractures, the former college student was forced to undergo two separate lobotomies that involved removing large portions of her brain. She was left afterward with the mental capacity of a 5th grader.
