Section 3 of the 14th Amendment. Exactly what was being discussed for months as their reasoning to try this.

The left and never Trump wings aren’t going to like what SCOTUS does with it. The plain language of Section 3 of the 14th Amendment excludes the office of the President under current SCOTUS jurisprudence.

The trial Court also held, however, that section 3 of the 14th Amendment does not apply to the office of the President. I think SCOTUS will reinstate that part of the ruling, and this entire argument will be defeated.

FTR, this entire 14th Amendment disqualification argument is being championed more by conservative and libertarian Never Trumpers than Democrats and liberals.


Explain to me like I have never taken a civics class how a state Supreme Court can decide whether someone committed a federal offense. That seems like something for the federal courts to decide.

That’s not the issue.

The issue is whether section 3 of the 14th amendment applies at all to POTUS, which is something only SCOTUS can ultimately decide.

But he has not been convicted of violating Section 3 of the 14th. In fact the Senate exonerated him.

They are both issues. Insurrection is a crime against the country not a crime against a state. No state court should be making any ruling involving whether anyone is guilty of insurrection whether they are president or not. This is not justice. This is politics masquerading as justice. These are not judges. They are political operatives masquerading as judges.

If this stands he will be eliminated from a bunch of state ballots. If he gets eliminated from a swing state ballot it’s over. This needs to get adjudicated before the primaries.

A Senate Impeachment Trial is not a Civil or Criminal Court.

But since Trump hasn’t been convicted of treason, I don’t see how that ruling stands. Since they stayed their own order, it seem pretty obvious that they’re admitting that it’s a blatant political move.
