Did you think the costume was a realistic depiction of a penis? I think it would be a closer case if she had a sign of actual dick pics that said "Don't be a dick-tator."
A cartoon costume, however, with a political protest sign is almost certainly not going to withstand a first amendment defense in the unlikely event that this prosecution proceeds. They will probably drop the prosecution if she waives bringing any civil action.

If that cop cannot explain this to his kids, then he has failed as a father.
