On May 2, 2025, the Vienna Regional Court for Civil Matters ruled in a case involving two men who had voluntarily agreed to resolve contractual disputes through Islamic arbitration.
Here are the important details:
The agreement: The two men agreed that disputes would be decided according to Islamic law (Ahlus-Sunnah wal-Jamaah).
The arbitration: A private Islamic arbitrator ordered one man to pay approximately €1 million.
The court's decision: The Vienna court upheld enforcement of the arbitration award. The amount being enforced in the particular proceedings was €320,000.
The reasoning: Austrian courts could enforce an arbitration award based on Islamic rules as long as its outcome did not violate fundamental principles of Austrian
