The court would likely require him to amend the lawsuit to sue the correct people.
The claims against DHS/Noem require him to show that an unconstitutional policy or practice was the “moving force” for his injuries. It’s really hard to prove that.
I have no idea if he can win on the merits. People say crazy things in lawsuits.

He should be imprisoned for years if he assaulted LE officers in the line of duty. Maybe more hefty fines if he simply impeded them. In low profile cases in small towns the arse whuppin' often serves as the de facto punishment but that shouldn't be the case when political violence is involved. Those broken ribs should be lagniappe and not a consideration when totalling the bill owed.
