If the perp is far away from you and hauling arse, you have successfully ended the threat. There is no need to fire an errant shot at him as he runs away. Unless you can prove you were actually shooting at an intruder, you'll probably be facing a felony charge.

Now, if you are in your house, all bets are off. If he is in your castle, you do what you have to do to protect yourself and your family.

I have read way too many stories where warning shots have been detrimental to the good guys. I highly advise you don't do it.


My warning shot question would only be outside if he was running away type deal, not shootin at him but sending a message. I know its against the law to discharge in a residential area, not sure how the cops would look towards this.

Firing the weapon after the threat has stopped (him running away) probably wouldn't end well. I'm by no means able to give legal advice, but it just seems like a waste of a bullet. Plus you could be adding "discharge of a weapon in city limits" to yourself. How can you prove that there was an intruder and you weren't just shooting in your backyard to piss off your neighboors?

My advice is don't do it. Period.

If he is hauling arse running from you away from your property, you have successfully ended the threat.

I just hate how so many people judge what they should do off movies.

Here's what movies taught me about defensive encounters:

1. A single bullet from any firearm (pistol, rifle, shotgun) will immediately kill someone, no matter where it hits them.

2. If I face a perp, we should point our guns at each other and have a stand-off before one of us gives a good one liner and pulls the trigger.

3. If someone is in my house unarmed, they will immediately freeze or run if I point my gun at them.

4. If they run away, shoot at their feet to say "...and STAY out!"

5. You should always rack your shotgun after the person has stepped into your house and make sure he or she can hear it.

6. If you have an exposed hammer on your gun, make sure you leave it down so that you can cock it back when you're aiming at your nemesis.

If we followed all the advice movies give us, a lot more good guys would be in jail.

If it went down like you said in the OP, I would say the weapon accidentally went off into the ground because you forgot to take your finger off the trigger in the heat of the moment.

My first shot (at 1st perp) will be the warning shot for anyone else still in my house or trying to get in my house.

If he's running away, that's what you want. Let the cops go track him down and arrest him. You just want him to leave with no harm done to you or your family.

If you're shooting them through your door, that's a different scenario. If they are trying to force entry into your home, that is an acceptable means of defending yourself.

Right, and the rolling of houses would lead to mass killings.

If he's planning on coming back I'd rather he not know I have guns until it's too late. It's better he bring a knife than a gun next time. He may also be more willing to risk coming back for firearms than for a laptop or a bigscreen. He failed and has two options try somewhere else or get better prepared and try again. I can't see any positives and several negatives to a warning shot.

In Texas, yes you can as long as he has possession of your property...shoot 'em square in the back if you want.

Here is one example.

Though I'm not an advocate of warning shots, I might do so in the situation you described.

Perhaps fire into the ground in front of me. If the police are involved, say that you were face-to-face with the guy and fired into the ground to scare him off because you didn't want to hurt anybody.

Excellent scenario to contemplate.
