I could be wrong but I read that as:
-arson
-burglary
-robbery
-agrevated robbery
-theft during the nighttime
-criminal mischief during the nighttime
If all of those crimes were supposed to fall under the "during the nighttime" category, I think there would've been a comma after theft as well.
I'm not an English professor, so there is a chance I'm wrong, but I don't think so.

I disagree with drawing only to use deadly force. I have drawn twice in self defense and been happy not to have to shoot. But had the perp had a fire arm showing I would have shot with out saying the first word.

you should always carry a insurance pistol or knife. that is if you shoot first and ask questions later.
