You get on a puddle jumper, you’re assuming risk. If the pilot lived and you were injured, sure... go after him for some compensation. Filing litigation against the son, who paid the ultimate price in losing his dad, is a POS move. frick those guys. Let insurance sort it out.

I don’t see how the NTSB doesn’t rule “pilot error” in some form or fashion. Not saying I agree with it, but they always blame the pilot for something.

Drown after swimming back to the plane for life jackets he gave to the folks suing his estate. Not sure why there was no life jacket requirement while in the air, it's mandatory on helos flying the gulf.

From reading this thread there is an insurance lawsuit that is under way and pending investigation. It reads that in addition to that they are suing TB's son to go after his assets since his some is the beneficiary. Those guys are real pieces of shite if that's the case. They lived. TB jr's dad died.

Float coats were the norm in the USN even for people that had some serious maritime survival skills....

They are suing the estate to go after insurance and could potentially go after estate assets. TB IV's assets are off limits. Now, if he accepts the estate he could be liable for debts of the estate up to the amount he inherited. So they could come after his assets to the extent he inherited them. He can always reject the estate and not worry about the debts.

You don't have to have an IFR to fly in bad weather. If you fly then sooner or later you are going to get caught in bad weather. It's not necessarily negligence.

on a commercial flight it is absolutely negligence and theophile was warned about this very thing on multiple occasions. He knew better but his pride got the best of him

Theophile was one of those guys that just knew how to do things. Everything came easy to him as far as working with his hands goes. He got caught with his pants down here and if he were here today he’d be the first to admit it

You’re likely correct

If his insurance coverage was sufficient/appropriate for his business, and properly meets the needs of the survivors, I will definitely feel different about the Scurlocks, regardless of their reasoning.

If this was done merely to expedite the claim process, I fully understand the Scurlocks

You willingly got on a plane. Gravity is real. If I am talking to the captain and he says the weather looks sketchy, what you wanna do.....I will be damned if I sue someones estate after they lost their life and I lived. Hell, I lived. Now, if there was some form of gross negligence that may be different but it doesnt seem this was the case.
