Court documents suggest 17-year-old girl accused in slaying of Zachary man Saturday was sexually abused by him as a child

Brittany Monk and her boyfriend, Jace Crehan, 21, are accused of strangling and stabbing Robert Noce on Saturday and then stuffing his body in a drum at his Zachary home.
According to a 2013 indictment, Noce, 47, was initially charged with the aggravated rape of a child referred to in the document as “BM” and whose birth date is listed as July 11, 1997. The Sheriff’s Office said Wednesday that Monk’s birthday is July 11, 1997.
The rape charge was later reduced and on June 22, Noce pleaded no contest to carnal knowledge of a juvenile and began serving a five-year term of supervised release, according to court records.
Noce was initially accused of having oral intercourse with a child when she was between 4 and 8 years old, according to a 2012 affidavit of probable cause. The abuse occurred between 2001 and 2009, and the victim notified her mother about the incidents in 2012, the document says.

I'm pretty certain that a 2nd Degree Murder guilty verdict in LA automatically gets you Life w/ no parole. Also, it only takes 10 of 12 to convict.

It shouldn't even come into evidence. It happened over three years ago. Plenty of time for "boiling blood" to cool.
ETA: She'll likely be charged with accessory after the fact, and probably won't be tried at all. But the boyfriend is likely fricked.

It actually happened when she was between 4-8; she finally told her mother just a few years ago. But his guilty plea/sentence was only 2 weeks ago, and his light punishment may have made a difference in her state of mind.

If he's made recent threats I can see that as a mitigating factor. But his crime from 10 years ago should not be considered in a trial of the boyfriend. Based on the law, of course. Not emotion.

I would also think that the justice system's total failure to mete out justice should be a factor too.
This girl has been failed by so many - thrown to a rapist by her mother and denied justice by the justice system. I think she will be a sympathetic figure to many and may get a lot of public support.

How does the prosecution try and establish a motivation for the crime? They will have evidence that the accused was at the crime scene, but is opportunity enough for a conviction?

The mother is an idiot, the guy was a piece of shite and the justice system completely failed this girl to such a point where she apparently lived in fear of the aforementioned shite-piece.
If I were on the jury I would be pushing for nullification due to the specifics of this case (as they appear right now, at least).

My piece of shite boss just tried to defend this guy.
My exact words before I could stop myself, "frick him, frick you, and frick people who think like you do."
We're in a fairly...academic setting, so everyone awkwardly laughed.
I followed it with, "seriously".
If it was open season on pedophiles tomorrow, I would use every tactic people are using to kill wild hogs. I do at least feel a twinge of regret when killing them, Wouldn't feel a damned thing for these moustachioed pieces of shite.

If they have evidence of the threats, those can open the door to the history of molestation he perpetrated on the girl. From there you explain that the resulting penalty Noce endured for the molestation was a complete failure as it allowed him to harass and threaten the young girl.
So we have someone whose mother has failed her, the justice system has failed and she is in complete fear for her life by a man who has already molested her multiple times. What other avenue would such a vulnerable young girl feel she had? Go to the cops again? That worked out well. Her mom? Useless.
The only snag would be if there are people on the jury that believe they must go with the letter of the law over the reality of the case.

If there was ever a case for jury nullification, this is it. Again, I can't see them even prosecuting the girl. But I think the boyfriend is up shite Creek.

The lifetime movie has to already be in the works.
I feel so bad for this girl, it breaks my heart that she endured so much and now will endure a criminal trial and will serve more jail time than the monster that stole her life.
I praise her for taking matters in her own hands where our society failed her repeatedly. She needs a hug and a scholarship.
