There are plenty of convictions from people that did not agree to a breathalyzer.

So after 90 days you just go to court on Mississippi's law. Worth it.

Refuse a field sobriety test. A cop can't make you walk a line.

As the previous poster asked, what happens when you refuse? You get taken to a hospital to have blood drawn and then jail for a couple days? Car is impounded? Have to post bail?

How do you get to work? Is the suspension of license for everything but true needs like work and grocery?

Friend of mine got a DWI in college and didn’t blow. His license was suspended for a year.

He got off the charges and still had no to go a year with no license.

This varies widely by state but if you look/act drunk and they haul you in thinking you are drunk in most states they will get a sample. Electronic warrants have made the system quick and easy and significantly removes the chances of sobering up before a sample is obtained.

Again this varies widely by state and I can't speak specifically to Mississippi.

Of course there are. But taking a test if you know you'll fail is giving them the evidence.

You go to jail. But you could end up going anyway if you blow and blow under. Cops can say you failed field sobriety and were not safe to drive.

And in Louisiana refusing now comes with ignition interlock. But you could still end up without a dwi because they wouldn’t actually have proof of you being over the limit.

Now obviously you could be totally shite housed and that would be on camera if you were falling over getting out of your vehicle.

In MS if you refuse, they get a judge to sign a warrant no matter the time of day or night, they bring you to the hospital and draw your blood. After booking they’ll release you but your vehicle has been towed so you’ll need to call somebody to come get you. Your license is suspended, you get a lawyer to help you get a provisional license for work and pray the blood test comes back below .08. If not, get ready to plead guilty and move on with your life if you didn’t kill or injure anybody.

Texas suspends you a year for a refused test

You can get a hardship license to go back and forth to work for $600.00 a month

This. Saw it on an episode of cops. Guy was boating. Was taken for admitting to a couple beers only and being the designated driver. He passed every sobriety test with no problem. Blew a 0.07. So they chalked it up to inaccuracy of the field equipment. Take him to the station for the “real” breathalyzer. He passed again. 0.07. They charge him because so much time has passed. For being a little redneck Oklahoma (I think) dude. He kept his shite together well. Popped off a couple times. But nothing physical and no threats. I probably would lose my shite.

I believe it got thrown out at trial.

Refuse and lawyer up. Unless you are visibly drunk your license won’t be suspended the full 90 days. It won’t be cheap though.
