Would you refuse a breathalyzer?

In Mississippi you will have your license suspended for 90 days. Seems you’d have a better chance in court if you refuse. Of course don’t drink and drive.

Yes
But an all honesty if you get a DUI with UBer and Lyft around these days you really are a dumbass.

In a heartbeat. No evidence, no conviction.

If you’ve been drinking, you’d better refuse.

Getting in a position to be breathalyzed in the first place is trashy.

Out of curiosity, what happens next if you refuse?

don't even have to have been drinking to get charged, and the expense and aggravation of just being charged is almost as bad as getting a conviction, don't give the prosecutor any ammo

Across the country, including in Louisiana, police are not asking a judge for a warrant and if approved, they are conducting a blood draw, by force if necessary. When this happens, you're billed as a refusal for driver's license suspension purposes, however they will now have the evidence to be presented in court to assist in convicting you.

I'm guessing your license gets suspended for 90 days.

I know in Colorado, it is the following penalties:
Automatic suspension of your Colorado driver's license for one year (though you can apply for a reinstatement of driving privileges after two months).
Designation as a Colorado “persistent drunk driver,” even if it is your first DUI arrest.
Participation in mandatory Colorado DUI classes and treatment programs.
An ignition interlock device on your vehicle for at least one year following the restoration of driving privileges, and
Carrying SR-22 insurance even if you are found not guilty of DUI.
So in essence you are pretty much given the same penalties as a regular DUI. Colorado also has what they call a DWAI, which you would get if you blow a .06 or higher.

Interesting question, but have never been asked to take one, most likely never will. Probably would take it, if being honest.

Failing a field sobriety test can't lead to a conviction?
Posted on 9/12/21 at 11:21 am to SixthAndBarone
Are they able to draw blood? I heard this, but don’t know if it’s bullshite or not.

That blows my mind that the government can do that to you even if you are found not guilty of the crime you’re accused of
