§136. Jurisdiction where offense committed in river between two parishes or in Gulf of Mexico

If any offense is alleged to have been committed in a river dividing two parishes, any court in either parish has territorial jurisdiction if otherwise competent as herein provided; if committed in any lake, bay, inlet, or other body of water bound by more than one parish, any court in any parish bordering on such waters has territorial jurisdiction if otherwise competent as herein provided.

If any offense is alleged to have been committed in the Gulf of Mexico within the waters of the state, any court in any parish bordering on the Gulf has territorial jurisdiction if otherwise competent as provided herein.

He was holding onto a crab trap, a whole lot different from swimming. The extra weight would have been an advantage in keeping his core body temperature up.

One of the Boating Safety Saturdays we went to in NOLA talked about how to survive in Pontchartrain. Conserving energy and staying where you are likely to be found were two of the major take aways.

There’s a huge difference between someone that can swim and is “trained” vs. someone that can open water swim in a survival situation.

I grew up as a kid swimming on a swim team in pools, I always considered myself a great swimmer. Until I grew up and as an adult started training for triathlons and ended doing a 1/2 Ironman, the swim was in Lake P. I’ve done open water swim competitions in the GOM, Lake P, several lakes and rivers. I don’t care how fit or how good of a swimmer you think you are, open water swimming is a whole different animal and if you’re not used to it you will panic and drown. Unfortunately that’s probably what happen in this sad situation

I would think they have jurisdiction since it goes into the gulf of mexico. What parishes boarder Lake Pontchartrain? St Charles, Jefferson, Orleans, St Tammany, Tangipahoa? That's a lot of government agencies and I could see it being chaos if all of them were involved.

NOPD has jurisdiction. She and the boat where both found in Orleans Parish. The coast guard can get involved anywhere they damn well please for rescue operations no matter if the body of water is land locked or not.

Jurisdiction is orleans parish for any state and or city/parish laws broken.


For any federal violations he coast guard has the honors- unless they defer to lDWF

Just because it flows into the gulf does not mean it's the coast guards realm



In that case bedico creek would also be their realm
