Woman in Berkeley arrested and charged with "Use of Offensive Words"

The "use of offensive words" piece is bullshite and unconstitutional, but this is a pretty important part of the story. They were trying to fence the driver.

Correct, and they were charged appropriately for those blatant crimes, and they should face penalties.

Using racial slurs or offensive words isn't a crime.

What did she say? And yes I understand she was arrested for more than just words, but the fact that charge was tacked on means it’s an offense that can be dealt with by police.

So I did some digging and it’s a subsection of their Disturbing the Peace. It’s basically the “fighting words” statute I think just very stupidly labeled.

It’s a little more aggressive than La’s but not that much different. So possibly nothing to see here.

Relevant CA code section, for those interreted:

Any of the following persons shall be punished by imprisonment in the county jail for a period of not more than 90 days, a fine of not more than four hundred dollars ($400), or both such imprisonment and fine:

(1) Any person who unlawfully fights in a public place or challenges another person in a public place to fight.

(2) Any person who maliciously and willfully disturbs another person by loud and unreasonable noise.

(3) Any person who uses offensive words in a public place which are inherently likely to provoke an immediate violent reaction.

People here love to get worked up about laws when they see the names, but they rarely bother to try to understand what they actually say.
