The woman and her partner proceeded to confront the package delivery driver on the 1700 block of Delaware Street, according to the alert, and then used force and “hateful language disparaging” people of color to prevent the driver from leaving.
Officers arrested the woman after the incident on suspicion of false imprisonment, battery, use of offensive words and willfully threatening an individual based on their perceived characteristics, the alert states.

Yes, this is real. In the United States of America (well, Berkeley), you can be charged with a blatantly unconstitutional charge of "use of offensive words".

Only certain words against certain people. Let's be realistic. It's Bezerkley.

Uttering a threat is an offense in many jurisdictions.

Fighting words are a thing.

The "use of offensive words" piece is bullshite and unconstitutional, but this is a pretty important part of the story. They were trying to fence the driver.

Don't think that is what this is.

Remember that saying of “sticks and stones”? Seems like ages ago.

Correct, and they were charged appropriately for those blatant crimes, and they should face penalties.
Using racial slurs or offensive words isn't a crime.

What did she say? And yes I understand she was arrested for more than just words, but the fact that charge was tacked on means it’s an offense that can be dealt with by police.

So....prosecuted for words?
This isn't liberalism. Modern leftists should embrace the fact that they are now largely authoritarian dirt bags and about as far from being real liberals as they could be.

Those have always been illegal in America.

Yeah. No one is arguing otherwise. Try to keep up, barrister.

Arrest probably had a bit more to do with these words.

So I did some digging and it’s a subsection of their Disturbing the Peace. It’s basically the “fighting words” statute I think just very stupidly labeled.
It’s a little more aggressive than La’s but not that much different. So possibly nothing to see here.

Relevant CA code section, for those interreted:
Any of the following persons shall be punished by imprisonment in the county jail for a period of not more than 90 days, a fine of not more than four hundred dollars ($400), or both such imprisonment and fine:
(1) Any person who unlawfully fights in a public place or challenges another person in a public place to fight.
(2) Any person who maliciously and willfully disturbs another person by loud and unreasonable noise.
(3) Any person who uses offensive words in a public place which are inherently likely to provoke an immediate violent reaction.
