You think the rational thing to do was break into an apartment and take things?

If she knew he had them why not do what I would call rational, and tell the police so that they can retrieve them once the restraining order is in place?

I just started reading the thread title to my gf and before I finished she says, “yeah I know her.”

ETA: Just looked at her photo. I’ve definitely seen her around.

Was it the best way to handle it? Likely not.

Was she in her most rational state after the initial incident? Likely not.

Would I convict her of a felony? Likely not.

I don’t know the specifics of Florida statutes, but burglary is usually a felony, while charges like breaking and entering or criminal trespassing are misdemeanors.

I have no problem with the police charging her because they couldn’t ignore her actions, but they had plenty of gray areas to charge her with a misdemeanor.

This is just blatantly untrue. At the time she took the guns he was in no way prohibited from possessing firearms. He hadn’t been convicted of anything and he hadn’t been afforded the opportunity for a hearing regarding the Court Order.

The fact is, the woman broke in his place and stole his property. She committed a felony crime.

First, the statement didn't make a distinction between a temporary RO and a final RO so arguably the statement is accurate. The key here is it appears there is only a temporary RO in place which does not prevent someone from lawfully possessing firearms.

Second, nobody here is arguing she did not commit a crime.

In my view it could have been the rational move. If he decides to press charges he can't get the guns back immediately. If she gets a final order the police will continue to hold the guns. Here crime might well have saved her life and she likely has a much better understanding of his obviously crazed Florida mind than we do.

The RO was issued the day prior and the guy has been in jail since it was issued. There is no way, temp or permanent, that he has had the notice and hearing requirements fulfilled to have prohibition take effect. The statement is false. You need to review the facts.
