My Civics textbook says you’re wrong...
would have to have probable cause. in this hypothetical assume the truck has nothing illegal inside it at all, brand new from dealership. the cop pulls you over because they thought your tint looked illegally dark. you drop the windows and when the cop walks up you exercise your right to remain silent

I think it would fit the obstruction of justice criteria here
Is illegal tint a crime or civil infraction in your state?

A cop can force you to do whatever he wants an a large chunk of this board will support him regardless of the legality.

would him seeing you drive by count as reasonable suspicion to enter the vehicle? doesn't seem like it if he couldnt prove the tint was illegal because the windows are rolled all the way down and he can't see them anymore
That’s like saying he saw the weed in your seat but then you stuff it in your glove box so it’s safe now.
Or you were speeding but you slowed down now so he can’t pull you over.
That’s not how it works.

If all you have to worry about is a tint ticket, it isn't going to be worth the hassle of forcing the officer to get a warrant. You will regret that decision, and still get a tint ticket.

not the same at all. speeding has a general speeding ticket violation on the books that they don't have to prove how fast you were going
marijuana they could just call in the drug dogs and sniff your truck and have probably cause
is there a window tint sniffing dog?

it's a hypothetical. I need some concrete laws I can cite to my friend of why this wouldn't work tho. surely there is something on the books that prevents this exact thing

He'll pull you from your car and pistol whip you, but as long as you are recording it you will end up a millionaire. Probably worth it.

Depending on the state, they can search it if they believe there is evidence of a crime in your car, if they believe a search is necessary for their own protection or if you have been arrested and the search is related to that arrest.

so not for a window tint? cuz according to an earlier poster that is not a crime but rather a civil infraction

In college I got like 4 window tint tickets.
It’s a non moving violation.

I have blacked out windows on my truck.
First of all, it’s a tint ticket. It won’t go on your license or insurance so don’t get all bothered by it.
No, i don’t enjoy getting tickets but F it! I like my tint more. In the summer it makes a massive difference in temperature

I find it BS that Louisiana tint laws are so much stricter than Texas

Too be honest I've often wondered about this.
I bought a truck in Texas from a ford dealership. Yes it was an F250. The windows had been legally tinted in Texas to 25%. Even had the Texas dotd emblem inside the tint.
I drove my new truck home to Louisiana and went to have my vehicle inspected to deem it legal in Louisiana. Passed inspection and was given an inspection sticker.
I still had my temp license plate from the Texas dealership when I was pulled over by a cop for illegally tinted windows.
He didn't tell me why he puled me over, he just asked me to roll my window up some. He immediately slapped a tint meter on the top edge of my window.
He said I was getting a ticket for illegal tint. I explained that I had just bought the truck at a Ford dealership in Texas and just the previous week had it inspected in Louisiana. He didn't care.
Now the way this meter works is that one side shines light through the glass and the part of the meter on the other side of the glass measures how much light passes through the glass. It has to be 40% in Louisiana.
Well he wrote me a ticket and I paid it.
What irks me is he placed the meter on my window without my consent. For the meter to work half of it has to be inside the glass, or from the inside of my vehicle.
So technically he had to enter my vehicle without consent or else he could not have taken the measurement.
I guess if it is a civil violation I don't see how he could have a probable cause that a crime has been committed. But who wants to hire an attorney to fight that battle.

Asinine comment. My eyes are sensitive to sun, i used to be able to get a sun allergy affidavit from the state police and my eye dr. but they fricked it up and it’s impossible to get. My tint is not legal but not blacked out. You can have driving in a fish tank.
