Never justified their behavior. My point was being calm doesn't make you somehow innocent or less of a murderer in this case.
Once all the facts come out, it will be up to the jury to decide, but nothing to this point has justified Hayes' shooting and killing Smith. Nothing.
Just as you can't claim you feared for your life and do what you want. It is like someone saying I saw a black man walking on the street 30 feet away, and they feared for their life, so they shot him. According to some of you, that is reasonable.

You realize when they read them the objective standard, that will be interpreted a million different ways by a million different people.

why the hyperbole? is that anywhere close to what happened here? there was a hit and run, another wreck, and then a confrontation.

On tape, Hayes just told McGaw a gun was in Hayes' hand.
so this is interesting. nobody else testified that hayes had a gun in hand. the previous witness just said that they were hand checking, so it would have been real obvious if he had a gun in hand.
