Right, and he was shot in the back. If his feet were in the street and his back was facing out but he still had his left hand on the steering wheel, it seems pretty clear to me that he was leaning into the car to reach for something, not getting in to drive off. The gun was right between the drivers seat and the center console.
ETA: it is still hard to explain how Smith's wife was shot twice

Except there is no indication from any testimony that his wife was shot before he decided to go to the car to get the gun.

it wouldn't be. but he's lying about everything, his wife is lying, Thomas is saying that he was starting shite and took a swing at O'Neal, etc.
plus you know there's going to be defense witnesses that say Smith said he had a gun in the car, etc.
it just looks really bad that someone in Smith's car was acting super belligerent and then lied about it on the stand. and yeah the jurors aren't supposed to be worried about that kind of thing but we all know that isn't the case.

What else do you think the forensic evidence will show? I don't even think the defense is arguing that Smith was shot in the back.
