It would mean that Smith fired his gun.
Evidence showed Smith's gun was FULLY loaded. Stop attacking me Fred and open up to my wisdom.

Right, and he was shot in the back. If his feet were in the street and his back was facing out but he still had his left hand on the steering wheel, it seems pretty clear to me that he was leaning into the car to reach for something, not getting in to drive off. The gun was right between the drivers seat and the center console.
ETA: it is still hard to explain how Smith's wife was shot twice
It just makes me question where the side shot came from
Posted on 12/7/16 at 2:03 pm to TigerBait1127
Maybe he was shot in the back first and was turning around when the last shot hit him in the side

No.

The evidence that wasn't retrieved until multiple days after?
The evidence that was reported didn't exist for nearly week?

that would make sense from the right side.
It is a question that has bothered me since when the autopsy came out

tin foil hat is all you got? will's gun was a 9mm caliber pistol, no 9mm casings were found, only 1 casing found in vehicle and was a .45. If Will was shooting at Cardell, them casings would have been flying out the vehicle. Not sure where you trying to go with that line of thinking.

IM thinking that smith and his wife were facing each other while she was pushing him away with smiths left side facing hayes toward the hummer. hayes shoots and hits her and smith in the side then smith turns and falls into his seat and hayes keeps shooting. I would have to see where the bullet entered and exited on her leg though. she ends up on the sidewalk on the side of a pt cruiser that was parked on the street. the pt cruiser was pretty much even with the impala and there was a foot or two of space between the back of the pt cruiser and the vehicle that was parked even with the g63. so she had to have fallen or crawled that way.

From Racquel's attorney peter thomson:
Thomson said that Racquel Smith walked her husband back to their vehicle, but that "the killer follows them" and shot Smith's wife in both her legs, from the side, as she stood with her husband on the driver's side of their SUV. Thomson said one .45-caliber bullet fractured her right femur near her knee, and another went through her left thigh.
"Moments later, the killer unloads eight shots into Will's back," Thomson said. "At no time during this event did Will Smith either brandish or carry a firearm."

from my best guesses, Racquel must have been facing semi sideways towards Benz, Will must have been turned away from benz to have left side exposed. coroner evidence will definitely be important.

Guilty. Hang him at dawn.

Guilty or not guilty I cannot imagine watching my spouse get shot in front of me.

Call it tin foil hat thinking.
Fuller was basically saying in his opening statements that the NOPD did a poor job of investigating since Will Smith was a local celebrity.
From the beginning the integrity of Ceravolo has been in question and will be part of the defense strategy to get Hayes acquitted.
There were questions early on why the gun wasn't found on the night of the incident.

Why do people feel that it is necessary that all evidence must be available to the media instantaneously after a crime is committed?
It is beyond pathetic that people are shitting on evidence clearly going against Hayes because it wasn't stated immediately.
It is not the responsibility of the police to provide the public with a instantaneous investigation and report. It is their job to ensure they get the evidence correctly and in a timely manner.

Fuller is an a-hole that makes a living crying wolf in every case he tries. Ceravolo wasn't on the scene per surveillance cameras of the hotel at the time. Fuller had a witness to alleged misconduct, it was a bullshite lie to plant seeds of misconduct to start building a shitty case. They've proven zero misconduct.

hayes was convicted by the public immediately due to smith being an ex-nfl player. that can be seen by anyone

Won't disagree with you.
I am just going by what was said during the early days after the shooting.
Chad wanted to know why the gun powder residue on Smith's hands would be important.
I responded on why and then the theories that were presented by the defense.
The NOPD reported immediately that no gun was found in Smith's car. Ceravolo was released from the NOPD a little more than a week after the shooting. It was being reported immediately that Ceravolo had an issue with Hayes because he was involved with the shooting Death of Hayes' father.
