there is no rule that says someone has to be armed in a self defense case.

All Murder 2 requires is a homicide and specific intent to kill. Shooting someone in the back 7 times would be specific intent to kill.
There's nothing in the statute that covers premeditation or anything like that anymore.
Its a source of confusion.
Manslaughter is a catch all for passion crimes or no specific intent to kill.
In the present case, Hayes could be charged with either and its fine. That is common.
They maybe should have gone with manslaughter to avoid confusion but its perfectly fine in this case in reality.
