Nope.

I don't find it reasonable for you to get out of your vehicle with it. I find that to be instigating.

If people are walking up to your car, drive off.

Fair enough. So you are of the impression Smith and Hernandez argued toe to toe with a man with a visible brandished gun?

at some point, i think if there was any possibility Will mentioned a gun, it was because Hayes had a gun. Period. Will wasn't throwing out, oh i got a gun and i'll show you how to use it if Hayes had never threatened with his gun first. That makes zero sense.

Racquel didn't testify to what Will knew. Racquel was walking will back to the car probably and admitted she had back to Hayes.

again... what? she did not say she saw a gun and never made mention of anyone saying they had a gun. same as mrs dooley.

Would you deem it reasonable if, as I suspect you may hear later, Cardell Hayes admitted to getting out of his car with a gun in his hand? Do you, as a reasonable person, expect that after an automobile accident you get out of your car and seeing the other person holding a gun?

I need to see something from Hayes' defense that creates a reasonable fear of his life BEFORE he takes out a gun.
You have a son. He gets in a wreck. Two men angrily approach his car, one with his shirt off acting like a deckhand on a tugboat. Do you advise your son to grab his gun? Not shoot, but grab it?

Thank god you are not on this jury.

This shite is insane. Its the very definition of not reasonable under the legal standard.

She said she separated the two men. It seems reasonable that she would have seen Hayes gun if he had it brandished correct?

there's plausible scenarios either way. I think it all went down so fast that she may have been in too much of a frenzy worrying about keeping Will away.

maybe cardelle wasn't trying to fight.
so we must just fight if one wants to and take the risk of brain damage? I would rather just shoot the dumbass and take my chance in court instead of possibly dying or being a vegetable the rest of my life.

of course this may not match this case but you can't say that someone should just possible take an arse whooping because one person starts swinging. what if cardelle wasn't 6'6. what if it was gasser in this situation?

Defense mentioned Hayes may have put gun in hummer door, never mentioned concealing in waistband.

I advise him to drive off. Getting out while armed is instigating.

Nice emotional argument tho

On the 911 call, Cardell Hayes is heard saying "I got out the car, the gun was in my hand." This was played at motions.

So. Is that reasonable?

I have already said I think Hayes exited with the gun. I am simply portraying other possibilities
