Legally, you would almost certainly be wrong. I'm making it seem black and white, but the law is always grey and a good defense can always make the waters muddy.
But case law on point would suggest that you are very, very very very wrong. There's case law going back almost 200 years on this.

So what if they did?
You can't respond with a goddamn gun.
What don't you people understand about this? Hayes getting out with a gun makes him the aggressor. Period.
well then I will go to jail if that happens to me. because I will pump them full of lead. and a revolver doesn't throw casings everywhere

or he could have done the thing normal people do. Call the police and report a hit and run and give the other car's plate.
same goes for will and his crew. they had a gun in the vehicle and think someone rammed them on purpose, but instead they get out and confront hayes and oneal angrily.

You will take someone's life because they are arguing with you after a car accident and take a couple of swings at you that don't connect?
Ok man. Sure.
Its times like this when maybe we need Pre-Crime.

My father is an attorney, and I will ask him how he interprets the law here.

Is the alleged hit and run the GIF in front of Juans that people keep posting?

Rodrigue asks if it would be smart to walk up to Hayes & try to reason with him. Dooley: "No. ... That could've made things worse."
what?
what?

OR he could not get out his car. Or call the police. Or drive off. Any number of things other than what he chose to do.

Him and his boy O'Neal have no chance against a shirtless idiot and a guy whose BAC was so high he should've had a hard time walking straight?
