But case law on point would suggest that you are very, very very very wrong. There's case law going back almost 200 years on this.

same goes for will and his crew. they had a gun in the vehicle and think someone rammed them on purpose, but instead they get out and confront hayes and oneal angrily.

So, from a legal sense, Hayes should have simply taken his arse whooping, and then got his gun if he was capable? He is not allowed to have his gun ready in case he needs to use it? He needs to be quick draw McGraw and jump in the car at just the right moment to retrieve the gun?

My father is an attorney, and I will ask him how he interprets the law here.

If two guys were to aggressively approach my vehicle I'd be a little apprehensive but not yet to the point where I feared for my life. I'd certainly be terrified for my life if someone approached me aggressively with a gun, regardless of whether it's in his hand or waistband.

OR he could not get out his car. Or call the police. Or drive off. Any number of things other than what he chose to do.
