Yes, you are still held unless they dismiss. Defendant needs 10 votes to win and be released.


damn. Not sure how I feel about that. Seems like at that point the state couldn't prove its case the defendant should be let go

First of all, on stuff like this it is never a good idea to put the defendant on the stand. While he/she can testify on his/her own behalf, he/she are also fair game for cross exam by the prosecution. That was a major tactical error as he really had nothing constructive that he could have contributed to his defense.

In terms of sentence, the range is 0-40 hard labor. It doesn't necessarily mean he is Angola bound. If his prior background is clean, I could see 20-25 with 10-15 of that suspended in lieu of probation upon release. Then again, it all depends upon the presentencing report and the Judge's take on things.

He had to testify, if you are arguing self defense your client has to take the stand if he is capable of coherently testifying.

no prior history of being a bad person. I think he just made a mistake in a stressful situation. unfortunately mistakes can have dire consequences. could potentially happen to anyone.

no people... it's 2 different cases w/ 2 different sets of facts... just like this one... let it play out in court

If he wouldn't have testified he may have been convicted of 2nd degree. This was never going to be a bit guilty on all charges. Fuller earned his money and did his job well.

Based on the little that we know, gassers situation seems more like the slam dunk to me.

And the optics of his road rage past are hard to ignore for my biased brain

yep. you never know when you can be put into a situation thru no doing of your own, and end up making a small misstep here or there and it cost you the ability to live a fulfilled life.
