If I am in a situation where I know that we are looking at a shite deal because the self-defense thing is "iffy", I would be doing every maneuver I could think of to keep him off the stand.

tLSU was all over this too. I thought they were crazy, but when tLSU laid out the reasoning, coupled with the fact that the prosecutors basically forced their hand, it made total sense. Very savvy prosecution move. It seems like a bad outcome for both sides, which is exactly why there was a jury trial, they couldn't agree.

the one and only thing Gasser has going for him is he stayed in his car.

that will be the key difference between the 2 cases

early on I think he gets manslaughter as well... but I think he may have a better chance than Hayes does due to the simple fact that he stayed in his vehicle the whole time

Possibly. But McKnight not even being close to his uncles gun will also hurt gasser more. And I doubt McKnight will be wasted. And I don't know if gasser will have witnesses say McKnight was the aggressor like this case said about smith

I am thinking the State gets murder for Gasser

Agreed. I still maintain it is better to be judged by 12 than carried by six. That said, a small misstep can turn your world upside down.

Without trying to sound insensitive, it is still better to be Hayes than smith. The families take the biggest blow on both sides

yeah no doubt. its such a fine line and the smallest of details can mean life in prison or getting off. if hayes has a scuff on his face, he likely gets off. if ross had said he heard both guys say gun like he did in the video from the scene, he prob gets off. Im talking from the perspective of the shooter. Obviously this was a great loss for the smith family.

Just have to reach in. Certainly nothing definitive right now, but it seems very plausible to me that it could have happened that way.

I just initially feel that gasser is a far bigger piece of shite then Hayes at the time of the killings. That is all. We will see what happens once the case starts and we get some witness testimony and evidence
