He had to testify, if you are arguing self defense your client has to take the stand if he is capable of coherently testifying.
If I am in a situation where I know that we are looking at a shite deal because the self-defense thing is "iffy", I would be doing every maneuver I could think of to keep him off the stand.
That said, I also see your point.

ESPN legal analyst Roger Cossack said in this situation it was okay to have him on the stand.
tLSU was all over this too. I thought they were crazy, but when tLSU laid out the reasoning, coupled with the fact that the prosecutors basically forced their hand, it made total sense. Very savvy prosecution move. It seems like a bad outcome for both sides, which is exactly why there was a jury trial, they couldn't agree.

Based on the little that we know, gassers situation seems more like the slam dunk to me.
And the optics of his road rage past are hard to ignore for my biased brain
I will be team Jefferson parish in the gasser case
the one and only thing Gasser has going for him is he stayed in his car.
that will be the key difference between the 2 cases
early on I think he gets manslaughter as well... but I think he may have a better chance than Hayes does due to the simple fact that he stayed in his vehicle the whole time

I am thinking the State gets murder for Gasser

Agreed. I still maintain it is better to be judged by 12 than carried by six. That said, a small misstep can turn your world upside down.

So they're saying the two no votes were for guilty as charged of murder now.

yeah no doubt. its such a fine line and the smallest of details can mean life in prison or getting off. if hayes has a scuff on his face, he likely gets off. if ross had said he heard both guys say gun like he did in the video from the scene, he prob gets off. Im talking from the perspective of the shooter. Obviously this was a great loss for the smith family.

castle doctrine
that... in my uneducated view... will be the play

Has to affect sentencing knowing that

yeah... but when you box me in by illegally parking on my passenger's side on the shoulder of the road and come up on my window
there may be something there
but like I said... I think he gets manslaughter too

Just have to reach in. Certainly nothing definitive right now, but it seems very plausible to me that it could have happened that way.

frick that is so depressing/anxiety inducing

I just initially feel that gasser is a far bigger piece of shite then Hayes at the time of the killings. That is all. We will see what happens once the case starts and we get some witness testimony and evidence
