The evidence showed that he did very little breaking before hitting Smith though. And it witness claimed that Smith first said "you did that on purpose" and Hayes replied "you hit me first." That doesn't exactly sound like an accident.

It really doesn't matter what Hayes said though after he claimed that he didn't shoot Racquel Smith. That destroyed any credibility he had. All the bullets came from his gun and he is obviously lying. Still, you never know what a jury will do regardless of all of the evidence.

You do realize that the data recorders in both of their cars showed that Hayes intentionally struck Smith as he came to a gradual stop right? What's funny is that Hayes was seen smashing on his brakes during the first incident on magazine, and wasn't pumping on brakes like he says he normally does to stop. If you're about to hit a car and trying to avoid a collision you smash on the brakes, that didn't happen. On the flip side, if you're trying to have someone rear end end you on Magazine street you smash on the brakes.

I don't recall that from the trial I was in a few years back, but maybe so?

Ours was easily unaninmous.

Actually, now that I think about it, 10-2 sounds right.

Well then I'm glad you're not on the jury. To blatantly ignore FACTS from data recorders and to completely ignore expert witness testimonies and then to believe Cardell hayes who just lied his arse off about 100 times on the stand shows that you have no interest in the truth in this case.

Ok cool so you didn't pay attention to the trial yesterday. It would do you both a lot of good to go back and read what the expert said.

True, you can't prove intentions. But it did show that he basically didn't slow down or really brake according to the data recorder.

I think Hayes gets convicted, but I don't agree with anything you said about the second accident.

Had he done it intentionally, he would have jumped out of his car irate. Not one witness claims that Hayes was irate. Not even Raquel.
