Calling McGaw back to the stand because got confused momentarily over two large black dudes with dreads wearing dashikis and allowing Napoli to have him reiterate that neither O'Neal or Hayes ever mentioned Smith having a gun let alone it being fired is incredibly stupid.

If state doesn't have any rebuttal evidence to present, then it's on to closing statements.

Im still wondering about that video recorded at the scene. A guy on the video clearly said that both guys mentioned gun. Why did we not hear from that person?

I think no way he gets not guilty. Im not sure on the legal stuff but i think i would go for manslaughter. I dont think he wanted to murder anyone and i think the smith clan put themselves and hayes in a bad situation.

Yea I'm not sure he will get murder, will he hard to prove that intent although intentionally slamming into the back of someone at 20 mph is extremely aggressive. Smith could've done a lot different and would be alive today. You had two hot heads and one of them had a gun. Wasn't going to end well and is very sad.

I went back and watched the 2nd accident video and clearly saw him "pump" the brakes like he said.

Can anyone give me a rundown of what happened before hayes testified? I was in the carlsbad caverns so no signal. Beautiful place btw.
