I'll ignore the expert and take a couple retards opinions on TD and Cardell Hayes opinion

There are a thousand wrecks a day where people do not hit the brakes at all and it is not intentional
Yeah and the funny thing is Hayes DID hit the brakes. The only thing the "expert" says that showed intent is that Hayes didn't have his foot on the gas. Hayes said he was trying to call 911 and was distracted. That makes sense to me. If I have to look at my phone while driving I just let the car coast without my foot on the gas.

Had he done it intentionally, he would have jumped out of his car irate. Not one witness claims that Hayes was irate. Not even Raquel.
You don't know what he "would have" done. The Smith car obviously had the people in it that would have been upset if they thought they were hit from behind on purpose.

Just please read the facts that were presented. Ignore what I say, that's fine, but don't ignore the expert witnesses. I believe very little of what any of the witnesses in Smith's car and Hayes' car have testified to. What I do believe are experts that can prove thing via impartial recorders.

So, what's going on now?

Why would all of them be looking behind in the first place???

An expert in no way shape or form can prove intent

Furthermore, the accidents aren't even that big of an issue.
The biggest issue is that Cardell Hayes says he saw a gun and fired, but there is no evidence that suggests that Will Smith had a gun, nor did anyone testify that he did.
That's what this ultimately comes down to. I can't imagine three people buying the story Fuller will present about a cover up in his closing statement.

defense is "publishing" its evidence to the jury... jury is looking it over
defense should rest next

Responsive verdicts to 2nd degree murder are att 2nd murder, manslaughter, att manslaughter and negligent homicide. Jury can convict on any

Huh? If someone is tailgating you and you hits you, then you look to see who it is that hit you obviously. It's likely they would recognize it as being the automobile that was in front of them just a short while before that. Whether he meant to hit him or not, he still got out of his car with his gun in-hand and ended up killing a man and shooting his wife.
Who shot Racquel Smith since Hayes just said he didn't shoot her? The evidence showed that the bullets all came from the same gun.

Jury has finished with exhibits, defense rests. State is going to put on a rebuttal case, starting with firearms expert Meredith Acosta

No. they said "he's gonna hit us" in testimony. Meaning they were already looking back.

I didn't see where they determined that Raquel's wounds were definitely from the same gun that killed will smith. I only heard about will smiths wounds. Maybe I missed that.

really doesn't matter what Hayes said though after he claimed that he didn't shoot Racquel Smith. That destroyed any credibility he had. All the bullets came from his gun and he is obviously lying. Still, you never know what a jury will do regardless of all of the evidence.
I wasn't there to catch the full exchange but I read it as "i had no intent and no idea how she got hit" and not "some mystery gun had to have done it and police forged ballistics"
I'm sure this firearms expert is to confirm he shot her now

My non biased opinion is that

negligent homicide

Oh, I wasn't following you. My guess is that he was tailgating them pretty closely and so usually the driver notices first when looking into the rearview mirror and that's my guess as to how they noticed (and they were right, he did hit them).
