Wow...really? I didn't realize that a juror couldn't take notes. How are they supposed to remember all of the testimony?

You would be shocked and appalled at the stupidity of some of the makeup of a jury of your peers.

I'll never forget that experience. We had one hold out. A Canadian woman from the West Bank that told us straight up in the beginning of deliberations that no matter what she didn't trust any police and basically without a video of the man doing it she just didn't know.

We finally got her to come around. It dear god she was a freaking moron and definitely not one of my "peers."

The judge actually met with us for a few minutes and said we got it right. Apparently the guy we convicted also was once convited on a mandlaughter beef, gotten out. The Circumstances of the manslaughter beef were almost exactly the same as the one we just convicted on. We didn't get to hear about the first one at our trial.

It won't shock me one bit if Hayes walks.


I have a similar story.

Served on a jury on a fairly high profile gang rape case. Couldn't believe I got picked.

I've edited out the details. Not a good idea to post about it, case is probably still on appeal.

Well, paragraph B allows it in certain situations:
B. A juror shall be permitted to take notes when agreement to granting such permission has been made between the defendant and the state in open court but not within the presence of the jury. The court shall provide the needed writing implements. Jurors may, but need not, take notes and such notes may be used during the jury's deliberations but shall not be preserved for review on appeal. The trial judge shall ensure the confidentiality of the notes during the course of trial and the jury's deliberation and shall cause the notes to be destroyed immediately upon return of the verdict.

QUESTION: What exactly are the charges? If the only charge brought is Murder-2, can the jury return the lesser charge of Manslaughter?

Yes, manslaughter is a responsive verdict.'

ETA: there are additional charges of attempted second degree murder and aggravated criminal damage.

One charge of aggravated assault was severed and is not at issue today.

I'm hearing the chances of Hayes testifying have gone from "no fricking way" to "highly fricking likely," mainly due to the fact that they can't locate their key witness.

The chances were never this except to those who know law from watching TV and who don't know Fuller.

I know. As I said previously, Fuller has called defendants more than anyone else in the building. Many of them quads. It was an 80% chance Hayes was taking the stand from the day this thing started.
