Has anyone testified to seeing Hayes shoot smith?
Ross was 10ft away but has no other detail besides Will Smith didn't do anything to warrant getting shot

He's never denied it as far as I'm aware. And isn't he on video/recording admitting to it?
My point is, the most important time sequence, the shooting, it seems like every witness so far has been focused on maniac mexican and o'neal.

I'm sure the lead investigator will tie it all together, including any confessions from Hayes, fingerprints on the gun, etc.

which i assume is why they just had an expert witness testify that the projectiles and shell casings came from the .45 they recovered from hayes

What I am getting at, is the defense has called multiple witnesses and provided evidence, yet they have not been able to provide anything on what smith or hayes was doing at the time of the shooting. Everyone was focused on the other people involved
ETA: Meant to say prosecution

they haven't called anyone.
And you're basing this on a few tweets.
Always remember that. Being in a court room and hearing literally hours upon hours of testimony is a completely different story.
These things almost always seem messy until a good closing ties it all together.

well if they can prove beyond a reasonable doubt that hayes is the one that shot smith, then smith's actions are really the most important since the defense attorney is arguing self defense

i know, but you're right that they still havent put hayes as the one that pulled the trigger with actual testimony yet
only people that heard the shooting, or saw hayes afterwards put the gun on the hood
im sure they'll eventually get a statement in of hayes admitting hes the shooter though

quote:Exactly. And the state has to prove beyond a reasonable doubt that smith did not do anything that would have hayes reasonably fear for his life.
then smith's actions are really the most important since the defense attorney is arguing self defense
They havent yet IMHO
A. The state proved beyond a reasonable doubt Hayes did not have a reasonable fear
B. The defense proved beyond a reasonable doubt Hayes did have a reasonable fear
C. Neither
I am on C

I think there is a layer here you are missing.
If Smith did NOT shoot a gun, then if there is residue his hands were close to a gun that went off.
Bingo if WS aggressively went after Hayes and a struggle for the gun ensued and it went off then this would also explain quite a bit as well. It would also explain the gun powder residue on WS's hands.

question for those that have been following:
