What does it take to deserve to get shot in the back 7 times?

the answer is exactly how you are responding to it. can't you see that.

So Hayes can have a gun pointed at him at point blank range, and smith wrestles with him to take the gun and gets shot.

I don't think that helps Hayes at all.

it doesn't have to pointed at him. maybe in the handchecking he felt it in his waistband.

He's a good lawyer but I don't think he has anything up his sleeve here.

His whole defense has been misdirection. He doesn't have much to work with so he's planting a lot of LOOK OVER HERE seeds. He's doing a good job of that.

It also goes but to the bad police investigation and corruption angle.

If Smith had residue on his hands and the gun wasn't recovered until the vehicle was being searched on Monday. Did Ceravolo remove the gun and place it back in the vehicle before it was "officially" found, like it was suggested by the defense to the media during the early days after the shooting?

You're just making shite up man. That's not how this works.

There's nothing in evidence to suggest this whatsoever.

That's 100% the plan. Its bullshite but that's the plan.

Fuller is good at doing that and from what I've heard from others its one of his biggest MO's.

It puts both angles of defense in play.

a. Smith did go for and fire his gun, but the police investigation covered it up to protect Smith.

or

b. In the chaos, Smith went after Hayes aggressively and he fired in self defense, bullet striking wife, then Smith retreated for his gun.

Both of them are far fetched. But better than having nothing. And all you need to do is try to create some doubt with jurors.

Acosta: If you eat a ham sandwich, you could test positive for a presumptive gunshot residue test.

Fuller had to have known this was going to be the answer. Now I am not sure what he is playing at.

Exactly

Not saying that is what happened and I find it strange that if the witness says that three guns were recovered from the scene when we know that Smith's gun wasn't. If that is where he is heading I would think now is the time to bring it up.

As I've said all along, it was just a LOOK OVER HERE thing. He never even asked if Smith had gun residue on him. Didn't even ask.

He wants to create as much confusion so he just drops all of these little insinuations all over the place in the hopes that the jury will pick up on a small point.

It would be bizarre to have a "trick up his sleeve" and not have the examiner admitting that there was gun powder residue on smith.
