There is no law that states you have to ticket the at fault vehicle. When the crash report is written whatevever vehicle is listed as vehicle #1 will be the at fault vehicle in almost all crashes.

Rarely does LE cite in accident anymore. Let's insurance deal with it.

Police do not determine fault, they only report the facts and evidence of the incident. Insurance Companies and court proceedings determine fault.

The issuance of tickets is the officer's discretion.

Apparently it's becoming common practice. My buddies wife pulled out in front of a college kid and the kid took her front end off. Kids dad shows up (off duty cop) and starts giving my buddy shite cause his vehicle was past inspection. Cop on call told buddy not to sweat it and gave the card with case number.

Bout a month later buddy is driving down Jefferson heading towards Essen. Chick pulls out of apartments, crosses over two lanes of traffic, enters the turn lane, drives down that a ways then exits turn lane in to the side of buddies SUV. No ticket, just card with case number. Now Owens Collision has had his vehicle held hostage for around 6months due to insurance company not agreeing to cost. Ownes also removed the rear windshield and it been raining in his car. He tried to bitch about it and they called the sheriffs office and had him removed from property. They now have a tarp on his car. Case being reviewed by someone in the DA's office now I believe.

I've been at fault but not ticketed years ago. Don't recall why.

I have been at fault an not gotten a ticket.

By the time the police arrived, I had already contacted my insurance company and provided the other driver with all the information they needed-Phone number, case number, we even scheduled a time for him to take his car to meet the adjuster. I was very sorry.

When you think about it, its pretty shitty to give tickets at all unless there's proof of intoxication/distraction/gross negligence.

Sometimes genuine accidents are going to happen - seems excessive to consider that a violation of the law. You're going to have enough of a headache dealing with insurance/body shop anyway.
