Why is it a state law that you have to take a lunch?

I don’t even eat lunch. I much rather go home 30 minutes early. My boss called me today to say that it’s a law and since I didn’t take one, he is taking it out of my time worked. I get the state trying to protect employee rights by giving them a breather but how is deducting pay for lunch when you actually worked those hours protecting your rights?

Is it law? I used to skip lunch all the time back when I worked retail while in school.

I thought it was only a law for people under the age of 18.

If you were paid during this time then yeah it's technically illegal.

I’m a PRN. I’m on call. I have other jobs where I’m my own boss and don’t have to take a lunch.

In high school when i worked at a grocery store if you didn't clock out in time you'd get in "trouble" which was usually just a don't do it again if you didn't regularly do it. This was due to a law about minors not working more than so many consecutive hours. Only time I've heard of this outside of a union rule. Never got pay deducted. I assume they'd just not give you hours or fire you if you kept doing it. Get paid for what you work.

I've never heard of a law that mandated lunch breaks, except for minor employees. But if you work through what was supposed to be your break time, the employer legally has to pay you.

Your boss is just being a hardass because they don't want to pay overtime but don't want to let you leave 30 minutes early instead of taking a lunch break because if that was an option, most employees would probably opt to leave early instead of take a lunch

I clocked out for lunch at my first job and went home. Came back an hour later and got my arse chewed. Lunch there (retail) was 30 minutes. I just laughed it off and said it was my first day and no one told me. They just said clock out and take your lunch. The boss was this mean old lady who tried to micromanage everything. You basically had 3-4 cashiers (my job) and about 8-10 people on the floor. She was all over the place. No one lasted more than a year.

Welp, its not.

Its a federal law. You are either afforded a 30min break for lunch where you are free and clear of your duties or you are paid to work through lunch and have to answer the phone in the middle of eating your whopper and fries.

If he is a private company and your hours of pay dictate you take a period of time off in he middle of the day for lunch or whatever, he is not obligated to pay you if you decide to work through that period unless he agrees to it or forces you to do it, nor is he obligated to allow you to leave early if you randomly decide to work through that same period.

His company, his rules.

It’s a hospital. If that’s the case, he needs to own it being their policy and not the state’s.
