defenders always get a bad rap but damn, they have a hell of an important job to do. If the prosecution can't show beyond a reasonable doubt that the person on trial is guilty then the defendant did their job well.

Innocent man in jail. You can't put a price on a man's life. If an innocent person gets 10 years for example and he is relatively young, he might be able to live out the rest of his life as a free man for many years, but they will never have a normal life. They will have a hard time finding a good job.. And he probably comes out a worse person than he was when he went in. That has to really take a lot out of a person.

The only way the question makes sense to to use equivalence when comparing.

Innocent man jailed for a string of serial killings means a serial killer goes free so your second scenario happens either way.

An innocent man jailed is way worse. Most people who committed a crime will commit another one. It's just a matter of time, such as OJ.

This isn't a shot at you, but the fact that this can even be open for discussion in America is kind of one of our biggest problems right now...our desire to relinquish our freedoms out of fear.

Maybe it's harder in the abstract...what if we personalize it. Would YOU consider being imprisoned for a crime you did not commit alright if it meant a guilty man would not go free? Or your son...or your father?

Why not randomly imprison men...you'll likely catch some guilty guys in the sweep that you didn't even know were guilty of anything and since the idea of catching innocent men is ok...is this also not for the good of society?

No...Franklin had it right and those men would be rolling over in their graves thinking about their posterity even considering this topic.
