Well that sounds a little circumstantial. Does it show his location at the time? Because if not, a decent defense lawyer can create reasonable doubt here.

Can't you manually enter activity? Seems to violate being tamper proof / chain of custody.

Had I posted this to the tech board I probably would have gone with a more "your phone testifying against you" title, but I felt this should be seen by a broader audience and made a title to fit said audience.

Based on that alone, of course. Certainly It’s just one piece of a multitude of evidence, though.

Circumstantial, yes. But it is a small piece to the larger puzzle.

When you lay this fact over the other pieces of evidence in the case, it adds strength to the prosecutors story. This bit of evidence could tip the scale for a juror experiencing a little reasonable doubt to no reasonable doubt.

there was dna evidence at the scene, as well as a witness...the suspect is also sketchy, at best.

dont ever use your phone before, during, or immediately after a crime. They can get your records and see what towers you hit and can show you were in that location. If you say you were in another place they already got you in a lie.

Phone spying is much much worse than this. For years now they know where you are every minute your phone is turned on and with you. They store data forever. Yes this data is accessible to authorities and admissible in court. Numerous people are in jail with its use.
