To be fair guys, this was a very amicable divorce. We weren’t going to sue for alimony or try to ruin each other’s lives. Basically this just saved us some lawyer and filing costs.

I've read that it isn't the recording that makes the marriage. When the marriage is recorded, that's an administrative act. The legal act has already occurred.
If it's amicable this probably doesn't matter. Just pretend it didn't happen, I guess.

Sorry, UM. I think I remember when you got married.
And they got rid of common law marriage here in Kentucky when it got attached to a gay marriage ordinance.

Not that simple. If you have accumulated any assets or liabilities, you certainly have community property issues. A spouse is not going to get screwed out of community property just because a marriage certificate was lost. Not to mention custody/support issues.

Didn't read everything, but this has the potential to be real bad concerning the IRS. They can take this to extremes because they can. They're retarded in a weird way.

How are they going to know? And as long As they acted as a married couple that’s all that matters. It’s not like they acted divorced and lived apart under different roofs or something else.
They’ll file separately or whatever next, and the IRS won’t know they officially got divorced or they just were never married.
It’s not like there’s someone at the IRS double checking the paperwork to make sure every couple that says they are is actually married.

If there was a ceremony, you ARE legally married with or without the paper work. If there is a witness to the ceremony, you are married in the eyes of the law.

those facts in La. mean you're married. a ceremony done by a person who you reasonably believe is legally capable of performing a marriage and you reasonably believe he/she married you, means you're married. don't take any chances. get the divorce or a court order declaring you never married.

There are people in other countries who hire American morons to file hundreds of fake US tax returns for refunds and don’t get caught for years if ever. The odds of this getting their attention is slim to none.
