Hahaha. You just doubled down on dumb.

If a cop suspects you of commuting a crime and gives a lawfull command, even if you are innocent, if you don't comply you are breaking the law. He absolutely DOES have an obligation to comply. That does NOT mean the cop can just start wailing on you with his night stick.

He can only arrest him after he had probable cause to believe he committed a crime. Do you really believe that happened here? He did, however, have reasonable suspicion to believe a crime was committed, and should have just asked for a receipt like every other rent a cop in America.

Police can't just arrest anyone because someone else says so.

You don't need to fight the cop to resist. If you stand perfectly still but refuse to follow lawful commands, like get on the ground, you are resisting. That doesn't mean the cop can strike you at that moment.

What's your angle here? Do EVERYTHING a cop says and the odds of getting fricked up go down? Yeah, that's completely correct. But, its also irrelevant as hell. The arse beating isn't the only ridiculous thing that happened.

He had full proof that he didn't steal anything. So at that point, he should have been left alone with his nice little arse kicking. fricked up still, but whatever.

The retard cop doesn't give two shits about the proof, though. Which IMO, pretty much shows that he never cared about theft at all. He just wanted to beat some arse. Complying was never going to be an option with this stupid arse cop. If a goddamned reciept didn't make the cop say, "oh, shite. Oh damn my bad," then he's to far gone to give a shite if anybody is complying or not.

I agree with everything you said, but the dipshit you're arguing with has an even more asinine point: if the perp would have simply complied and accepted the arse beating he would not have gotten arrested after the jackboot had blown off enough steam to collect his wits.

Regarding my "confidence", I'm confident that the old dude would not have gotten his leg broken if he had complied with the cop's order.

And I'm confident that I would have escaped that same scenario without any blows being struck, and would have received an apology after the cop was shown my receipt.

Walmart company policy is not to approach a shoplifter until that person has passed the last POS (register) which usually means once they are in the vestibule.

Police do not have to follow this, if they see someone conceal anything or suspect someone has concealed something they can stop them anywhere in the store or outside the store.

Security hired to work for Walmart must follow walmarts policy stated in the first paragraph.

I asked before, but you didn't respond. I will ask again- where did the cop have probable cause to believe a crime was committed? He can't arrest someone until that's established. It's not a lawful command unless there's a lawful arrest. If he would have asked where the receipt was that would have been within his rights. Unfortunately that didn't happen. Yet you still think he's justified.

I have to ask again- on what grounds?

There are times where getting on the ground when ordered to is pretty much a must.

Cop runs up to you guns drawn and yells get on the ground....get on the ground.

Someone runs up in a bank holding M16s and yells get on the ground....get on that ground.

But if some loser tells me to get in the ground as I'm leaving a flippin' Walmart, I'm going to assume we can have a mature discussion about why I need to do that shite. Everyone has been leaving a store and been stopped or had the alarms go off. You turn around, giggle, and say, "ahhhh I swear I'm not stealing lol."

Talks ensue, and the shite is solved. For frick's sake, even if he was stealing veggies, nobody should have had a leg broken.

"I know you're stealing veggies, some people say they're fruit...but we'll talk about that in my patrol car. I'm now going to arrest you."

"Sir, I'm not stealing. Here's my reciept."

"Alright fine, you smartass piece of shite. You're lucky you had that reciept that shows you're doing nothing wrong. I was so gonna get you, buster."

As dumb as the cop would have been in that there situation, it still would have been better than what he did.

How does anybody defend this?
